The NOA1 will only be sent to a US address.

This isn't true.  I received my NOA1 in the mail using my Thailand address.

Then I am mistaken. I believe I read somewhere at some time that USCIS would not send to a foreign address. But somewhere and some time = sometimes you get it wrong. Thanks for the correction.

Couple of points to consider.

  1. The petitioner's income taxes are required to be up to date even if they have been living overseas to successfully interview.
  2. The NOA1 will only be sent to a US address.
  3. The G-1145 E-Notification of Application/Petition Acceptance, can't be depended on. Some receive it and others do not. It's haphazard who does and who doesn't receive the email.
  4. It takes up to 30-45 days to receive the NOA1.

Here is an article speaking of how to handle the domicile question: https://www.visatutor.com/k-1-visa-i-134-domicile-requirements/

There are other sources that speak to this issue. Become educated before you get bit in the rear end. Use google to search on this topic. Good luck and stay engaged.

That's a super helpful article...saving it for later! Thank you for sharing!

I think, after reading this, we should be okay...I have a visa that expires that I don't intend to renew, voting in the upcoming election overseas, maintain a bank account, and and my "employment" is volunteering for a non-profit organization based in the USA (which means I won't have a tax return this year due to being a volunteer sans salary). So I think all of that should establish domicile. I might try to look for remote work online prior to interview-stage as well.

Thanks for pointing us towards that!

This is completely incorrect. Many people - including myself - have filed from overseas successfully. I got my NOA1 in about 2 weeks.

Thanks! when did you submit your petition? did you use your foreign address for correspondence?

I ask you both because I have not received a response and it has nearly been one month...

In June.  It took about a month after I mailed my petition for the NOA1 to arrive in Thailand.

Thanks APA, Dr. Bob for sharing!

I just got notified my petition has been rejected because I used a foreign address for 'Petitioners mailing address'

I need to use my US address like you both have done.  hopefully I will have better luck next time.
