Why was the visa/AOS denied?

It was denied because the marriage was suspected to be stage and in the process of resubmitting/re-filing I found out she's pregnant. She even confess to our lawyer

You can remarry if you want, but you cannot do adjustment of status through marriage to a green card holder (LPR, lawful permanent resident) if you are, or ever have been, out of status. If you have been in overstay longer than 180 days, you will get a 3-year ban on entry to the US when you leave. If the overstay is longer than a year, it’s a ten-year ban.

You can marry.  But you can not do an Adjustment of Status because she is not yet a citizen.  You would need to return and be interviewed in Nigeria.

October 29, 2018 Applied for Social Security Card - November 5, 2018 Social Security Card received

November 6th, 2018 State ID Card Received, Applied for Global Entry - Feb 8,2019 Approved.

July 14, 2020 Removal of Conditions submitted by mail  July 12, 2021 Biometrics Completed

August 6, 2021 N-400 submitted by mail

September 7, 2021 I-751 Interview, Sept 8 Approved and Card Being Produced

October 21, 2021 N-400 Biometrics Completed  

November 30,2021  Interview, Approval and Oath

December 10, 2021 US Passport Issued

August 12, 2022 PHL Dual Nationality Re-established & Passport Approved 

April 6,2023 Legally Separated - Oh well

See, this is what looks suspicious. You must have found all this out after your last thread, late November 2019. 


 

You have already had time to not only find all this out and divorce her but also meet someone new and already be setting up a new marriage, all less than a year later. This is why your motives will get questioned - not only here but also and more importantly by USCIS.

We are not getting married now, the relationship is just 5 months old but my girlfriend is already talking about the plan so we are looking towards next year not this year. We just needs some clarification. I hope you understand me
