My fiancé who I am sponsoring to the us with a k1 had a problem with the law when she was 17. She was accused of “suspicion of possession” for marijuana. It has been expunged from her record. I have a few questions:

1. Will this show up on the background check?

2. Is it a problem since it happened when she was a minor and she’s a few years older now?

3. Will I have to submit any documentation of this event even if doesn’t show up on the background check?

4. What documents will we need?

5. What if we can’t find these documents?

1. Will this show up on the background check? government. Funny thing is your government knows everything about you and me. Yes, they will know there was a case.

2. Is it a problem since it happened when she was a minor and she’s a few years older now? Still must be reported. A bit of advice, tell the truth when answering any questions from anyone involved with this process (i.e. USCIS, NVC or your embassy.

3. Will I have to submit any documentation of this event even if doesn’t show up on the background check? If you are asked, usually with an RFE from USCIS which delays your submission and final adjudication, yes you will need to submit court case papers.

4. What documents will we need? See the links below.

5. What if we can’t find these document?   authority that you are trying to us to gain the documents from can give you a letter stating that nothing was found or available from their jurisdiction.

*Background checks include checks of criminal, national security, and other information.

Thank you for the useful information. Will a document from the police stating that the aforementioned investigation was disconnected suffice as proof? I don’t believe there was any other documentation of the case.
