I started looking into starting the petition for my half brother and sisters (maternal), and after looking at the instruction here at VJ and USCIS, they no longer require the form G325? Is this correct? So, I can just file the petition online without having them sign anything?

it was never needed for family petitions, only for spousal visas, and the G325A has been replaced by the i130A, but only for spousal petitions

 

 

 

Oh ok. Good to know. No photos necessary for the petitioner and the beneficiaries too, right? I have a nephew and I know he will be a derivative, but do I need to submit his birth certificate too?

Hm. How old is he? You do know that sibling visas for Philippines (I’m assuming from the flag in your profile) are likely to take longer than 20 years from now? Unless he’s very young there is a good chance your nephew will age out.

I totally forgot about that. He is turning 5 this year. He might really age out.

So, I know I may be getting ahead of my self here, but is this how the CSPA calculation looks like?

 

Age at the time visa becomes available: 25 years (300)
Priority date: 10/2020
Approval date (priority date become current?): 10/2040
Pending: 240 months
CSPA age: 60 months (5 years) - Means, he is under 21?

You can have absolutely no idea how long processing time to approval will be, but for these cases as a rule it will be years (it can vary widely over time), but nowhere near as long as the wait for the priority date to become current. Your calculation assumes they are the same - they’re not (or no one would ever age out). Processing time to approval is how long uscis takes to get to the petition’s place in the queue and check everything looks right on the face of it, before transferring it to NVC. It can still be many years wait after that for the priority date to be current.

I know that I don't know exactly when the petition is going to be approved. The purpose of the dates above is to understand better the calculation for to qualify for CSPA.

Yes, but it’s pointless doing it now without knowing any dates. What is important is that you understand approval date is not the same as when the priority date is current.

Thank you for the information regarding the approval date and priority date. That helps. However, pointless or not, I like to understand things clearly. I know that a lot of things can happen in 20+ years. So, thanks anyway.

Correct. Eventually it's going to ask you: "For whom are you filing this petition? Select the relationship the beneficiary has to you (e.g., if the beneficiary is your parent, select "Parent")." You will select "Sibling"
