I know lying to immigration officials is a crime. Is lying to airline check-in agents also a crime? If it is not, is it against the TOS?

A link would be helpful, thanks.

The airlines are not stupid.  They will check for entry stamps in people's passports.  Not their first time in dealing with this problem.

Google for examples of airlines not boarding LPRs out of the US for more than a year.

The airline faces big fines and must repatriate the traveller if they board a passenger  who is refused at entry because of foreseeable visa / passport issues

Indeed! Better safe than sorry. The airline I work for takes the approach of erring on the side of caution. It’s not our decision whether the person has abandoned their residency or not, and with the fines in the tens of thousands it’s a risk we cannot take.

Any particular reason she has not naturalised?

Many countries (I believe most) including mine don’t stamp citizens passports upon entry, neither does the USA stamp passports upon exit. 🤔 Doe every permanent who got denied boarding for staying outside for more than a year, I can conjecture there are at least 99 who actually did board and arrive in the USA.

My question however remains unanswered. Is it against the law to tell an untruth to checkin agents and against the TOS?

They run the passenger when she registers to board.  Tangled us up a couple times

Hi,

I am a naturalized us citizen and staying in Texas for last 20 years. My mom got her green card in 2005 through me.

She is out of USA since last December and would not be back in USA this year because of COVID-19.

I am thinking about try to apply returning resident visa after COVID-19 vaccine gets distributed for the public.

My question is what are the steps of for returning resident visa (SB1), looks like after SB1 approved we need to file immigration visa.

I am confused about immigration visa part after SB1. After SB1 gets approved can she travel back to USA. Or she has to do the immigrant visa processing in consulate/nvc before she returns to USA.

Please clarify on this. Thanks in advance.

Here ya go.  It’s all here, every step

No NVC, everything’s processed at the embassy.

When she applies, she’s gotta turn in her green card.  If denied, I can’t say if she ever gets it back or not.  Risky exercise.
