I’m sorry to make this topic again, but can’t find clear guidance on these forums or from USCIS itself.

 

My wife and I just received an RFE, requesting us to send in the “current version of I-485,” which can be found on the USCIS website.

 

Apparently they are considering the I-485 we previously mailed “outdated,” even though we were “in process” before the February rule change.

 

That’s fine, whatever, mistakes happen and it’s annoying, and sending in a new I-485 doesn’t seem like a big deal. 
 

Where the confusion and frustration sets in is whether this new I-485 requires us to send in the same evidence we sent with our previous I-485. I’m talking about the evidence specified in the I-485 instructions: photographs, ID, birth cert., marriage cert., etc.

 

Would we be required to send ALL OF THAT over again with our updated I-485. I have a hard time believing that’s the case, since they have all of our original documents anyway, but the uncertainty is driving me CRAZY.

Respond to the RFE literally as requested.   Do not make assumptions and add words to the request.

Usually they would reject the whole  package but if you simply get the rfe for updated form, just send the form. Remember to submit any new documents like i944 applicable to the latest version of the i485.

Did you send original documents with your i485 earlier?

2015-06-16: I-130 Sent

2015-08-17: I-130 approved

2015-09-23: NVC received file

2015-10-05: NVC assigned Case number, Invoice ID & Beneficiary ID

2016-06-30: DS-261 completed, AOS Fee Paid, WL received

2016-07-05: Received IV invoice, IV Fee Paid

2016-07-06: DS-260 Submitted

2016-07-07: AOS and IV Package mailed

2016-07-08: NVC Scan

2016-08-08: Case Complete

2017-06-30: Interview, approved

2017-07-04: Visa in hand

2017-08-01: Entry to US

Did you send original documents with your i485 earlier?


Yes we sent the original docs requested along with I-485 earlier. RFE requested updated I-485 (no mention of evidence e.g. marriage certificate) and RFE also requested I-944 Declaration of Self Sufficiency. 
 

Sounds like originally submitted I-485 should have just been rejected for usage of incorrect forms, but ours (for whatever reason) made it deeper into the process than others who received the rejection for incorrect forms around that time. 
 

We postmarked on Feb. 22, and the new I-485 forms were required for anything postmarked on or after the 24th. It’s frustrating when USCIS doesn’t follow their own stated policy.

A lot of people that sent on the 22nd is receiving the same RFE. You can always try to call them as ask why that happened, but I don't think it's gonna change anything. 

 

Just download the forms and send the RFE.

Yes but do I need all of that supporting documentation listed in the instructions of the I-485? We’ve already sent passport photos etc. with the old I-485. Do we need to send them again?

The RFE only says to send the updated form. So try not to overthink.

Hi, same RFE, yes I called USCIS and after hoers of waiting one of them told my to send just form I 485 and other told me to send everything... so they are not very helpful.
