Expiring passport with i-94 but valid E2 Visa? (Green Card thru Marriage)

Hello,
I am sending out tomorrow the complete paperwork for my green card thru marriage:
FORM G-1145
MARRIAGE CERTIFICATE+ 2 AFFIDAVIT LETTER OF SUPPORT

FORM I-130 + $535 CHECK PAYMENT

FORM I130-A

FORM I-131
FORM I-508
FORM I-693
FORM I-485 $1225 CHECK PAYMENT

FORM I-765

FORM I-864
FORM I-994

+ all related paperwork needed.

Just a quick question please my passport is expiring on 05/26/20 with my i-94 expiring the same day.
My E2 visa expires 01/27/21. I can't renew my passport the Italian embassy is closed because Covid-19.
If I send out the paperwork now and they will process it after my passport is expired with the i-94 expired as well, would I have issues or the tracking number for the delivery will suffice to prove that I sent the paperwork out before the i-94 expiration?

Many thanks
Adam

While the delivery tracking number does prove you sent the paperwork before i-94 expiration, it is meaningless in legal terms. The date USCIS receive and accept your package matters regardless of when they process it. Anyway being a USC spouse you don’t have to worry even if it is sent after i94 expiry.

You are describing non-issues.  Just proceed without worry.  You are in an "Adjustment of Status" process, so expect to see this topic moved to the correct forum.
