Affidavit letter from family and friends.

Hello All,

 

 Would like to ask about the Affidavit letter, could it be from non USC nor a resident in the US, for example from my sister that is visiting in the US?

Am in the process of compiling my I751 form and documents therefore, am here more often to ask.  Also If there are some folks that due to file by end April or around this time maybe we can

share our thoughts and experiences.

I would suggest concentrating on stronger evidence.  Affidavits are weak, and are not required.   We did not use affidavits because they are not worth the trouble of generating, notarizing, etc.

IT Professional- Retired- Web Site Design, Hardware Maintenance, Compound Pharmacy Software Trainer, On-site go live support, Database Manager, App Designer.

August 7, 2022: Wife filed N-400 Online under 5 year rule.

November 10, 2022: Received "Interview is scheduled" letter.

December 12, 2022:  Received email from Dallas office informing me (spouse) to be there for combo interview.

December 14, 2022: Combo Interview for I-751 and N-400 Conducted.

January 26, 2023: Wife's Oath Ceremony completed at the Plano Event Center, Plano, Texas!!!😁

February 6, 2023: Wife's Passport Application submitted in Dallas, Texas.

March 21, 2023:   Wife's Passport Delivered!!!!

May 15, 2023 (about):  Naturalization Certificate returned from Passport agency!!

 

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

I think it is important to have it as it is  in the instructions of I751  where the part of Evidences of the relationship explained:

5. Affidavits sworn to or affirmed by at least two people who have known both of you since your conditional residence was granted and have personal knowledge of your marriage and relationship. (Such persons may be required to testify before an immigration officer as to the information contained in the affidavit.) The original affidavit must be submitted and also contain the following information regarding the person making the affidavit: his or her full name and address; date and place of birth; relationship to you or your spouse, if any; and full information and complete details explaining how the person acquired his or her knowledge. Affidavits must be supported by other types of evidence listed above.

 

 

 the following list of evidences are what we have:

 

Medical insurance with both names on the policy

cars insurance with both names on the policy

home insurance with both names on the policy

Rental insurance with both names on the policy

tax script for the past 3 years filed together

joint saving account for the past 14 month

joint credit card for the past 7 month

 joint leasing contract for our current resident

joint electricity and internet bills

general power of attorney from me to my husband

life insurance with my name as the beneficiary from my husband

Costco membership with both names

some mails that was received by both of us to the same address

our driving license has the same address on them

parcel pending notification by emails for both of us indicating the same address.

 

We don't have many pictures only some with my mom and sisters

 

Would like to know if the above is good enough or we are short in Evidences?

Looks good to me......don't forget that affidavits must be notarized....and remember the people are subject to being interviewed....

Apartment lease with both our names & signatures
Periodic Joint bank checking acct statements since wife's arrival in June 2017.
Deed for new home with both our names
Mortgage Lender Letter with both our names.
Credit Cards showing both on joint account with same card number.
Amazon delivery label showing both names and our current address.
Wife's Military Dependent ID card showing me as the sponsor.
Tricare Eligibility Letter showing both of us together.
Military pay statement showing wife as my benefic.
Texas Health Care Directives appointing each other as sole health care proxy(Advanced Directives)
Our Texas driver's licenses with same address for both of us
2018 Joint Tax Returns 
Pictures of us on special occasions here in the US.
Car Insurance Cards showing both of us as insured drivers for our car
Boarding Passes for Las Vegas Valentine Day Trip 2019
Utility application showing both our names for our current address

affidavits are very poor evidence. yes, they are allowed, but if you are a 'normal'/ married couple, they are unnecessary

 

jointly filed taxes

credit cards

bank accounts

wills/poa's

insurances

bills/utilities

home ownership/apartment rental

loans

 

all these things are are typically in both peoples names and accounts used by both is what they are truly looking for

i 485, 130, EAD and AP

04/09/2019    NOA1 received/check cashed i 485 and 130 (direct adjustment)

11/7/2019      Interview- Norfolk

11/10/2019    APPROVED (notification rec'd 11/10, approval dated 11/8)

DONE FOR TWO YEARS!!! ;)

 

Filed everything ourselves with no RFE's or delays.

 

CR1 for Child under 21 (20 at time of filing)- Filed by LPR Spouse for his son

4/4/20     Mailed packet

4/12/20   NOA1 rec'd

10/14/21 (havent heard anything... when do i start to get worried?)

9/15/22 APPROVED! Now to wait for NVC and interview....

 

ROC

10/14/21 Mailed to AZ PO Box. Let the waiting begin. Again.

10/16/21 Received at PO Box

10/19/21 Received Text NOA1

10/23/21 Received Mailed NOA1

I do notice both of our friends letters have:

 

"I swear, under penalty of perjury, that the foregoing is true and correct to the best of my knowledge." 

 

so that is a must have, and it would be great if they include their contact information (you'll never know)

No but a letter or affidavit from your sister who sees you once a year isnt as strong as someone who sees you both monthly.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).
