Hi,

I am looking for some insight in this case: I mailed my adjustment of status application (with working permit, travel doc...) at the end of Feb. I still haven't received anything, even though I have this weird feeling that they will return it because of the recent form changes. In all this, my B1 visa of six month will expire on April 8th. Now with the virus, my chance is even lower now at this point. If I don't receive a notice by then, I think my status will become Illegal, basically, which could lead to a entry ban in the future, possibly...I sound like Mister Doum, but I am just not sure on what to do because I don't want to be away from my family anymore.

 

What is my best course of action in this case?

- Feb 22 2020 - Mailed Application (I-130, I-845....) to Chicago

- April 22 2020 - NOA 1

- June 1 2020 - RFE for I-944

- June 24 2020 - Replied to RFE

- Oct 25 2020 - Fingerprint done

- Nov 9 2020 - Case ready to be scheduled for interview

If you AOSed then that B1 is probably cancelled anyway.   What bases are you adjusting from?   If marriage, then did you include the I-130/I-130A.   Did you include a G-1145 for electronic notification?

June 15, 2018  I-130 DCF Appointment in Juarez  -  June 18, 2018  Approval E-Mail

August 2, 2018 Case Complete At Consulate

September 25, 2018 Interview in CDJ and Approved!

October 7, 2018 In the USA

October 27, 2018 Green Card received 

October 29, 2018 Applied for Social Security Card - November 5, 2018 Social Security Card received

November 6th, 2018 State ID Card Received, Applied for Global Entry - Feb 8,2019 Approved.

July 14, 2020 Removal of Conditions submitted by mail  July 12, 2021 Biometrics Completed

August 6, 2021 N-400 submitted by mail

September 7, 2021 I-751 Interview, Sept 8 Approved and Card Being Produced

October 21, 2021 N-400 Biometrics Completed  

November 30,2021  Interview, Approval and Oath

December 10, 2021 US Passport Issued

August 12, 2022 PHL Dual Nationality Re-established & Passport Approved 

April 6,2023 Legally Separated - Oh well

Same as last time you posted the question.  You are adjusting status based on marriage to a US citizen, correct?  Why would you have to be away from your family?  At this point, the virus doesn't affect anything related to your Adjustment of status case.  You have to be patient and wait.

 

Once you file a proper I-485, you will be granted authorized stay.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

If you're already file AOS, don't worry about your B1 Visa anymore. You're legal to stay in US right now

During these times it is not unusually to experience delays. Most of the time our personal expectations are not always the outcome from USCIS. Patience. Took us 14 months to get our approval back when.

 

If on the date you submitted your AOS package if the dates were current then you have nothing to worry about.

 

The B-1 is DEAD by way of you entering the US on a K-1 visa.

 

Once you submit your AOS you are not out of status pending the outcome of your submission. So no need to worry. 

 

"What is my best course of action in this case?" Do nothing but sit tight. Your progressing like millions of others who have gone before you.

It's based of marriage to a US citizen (been married for a while). Yes, I did send the I-130, I-485, etc...My issue is that they haven't sent me any notification, even though they received the package since Feb 24th.

I think the B1 is valid since my application is not found in their system yet.
