This is what my embassy answered Me

Thank you for your email.  The form DS-5540 is required for anyone interviewing for an immigrant visa on February 24th or after.  If you are interviewing after this date, please bring the completed form to your interview.

Best,

Consular Section

@Muhirwa&flowers : could you tell who will fill up the form? Is it needed to submit it in CEAC system? To inform you my docs are already Documentay Qualified last of this January 2020.

Beneficiary needs to fill out that form

@Muhirwa&flowers : do I need to upload it in CEAC site? Or bring the form during interview time?

It’s better to bring to the interview because consular section told me to come with the form

This applies to the K-1 visa even though it is considered a non-immigrant visa?

Only for CR1/IR1 it appears.

A K1 benificiary will do the I-944 at AOS.

okay thank you

this was posted in K-1 Fiance(e) Visa Process and Procedures by individuals apparently doing K-1 visas as well which is why I was confused. Perhaps some timelines filled out wrong? I am unsure but thank you for your response

it’s better to contact your embassy to make sure because embassies are different me I contacted them and told me to come with it so it won’t hurt if you fill it out as a beneficiary and come with it to your interview day 👋

Would it not be easy just to fill out the form ahead of ANY type of interview and bring it with you. This way, if they ask you will have it available.

I went ahead and had my fiance fill it out and she will have it with her, just in case.

Best,

there is another post, where DS5540 is not required. it all depends on embassy & situation. if you have red flags. they will request it

PART 4 of DS5540

6. List below all U.S. federal tax returns you have filed within the last three years and attach your IRS transcript (or copy of the complete, filed tax return) for your most recent U.S. federal tax return.

So I was employed in the US from June 2016 to June 2017. Do I have to provide the IRS transcript for 2017?
