Hello guys!! Have a good day! I’m just wondering if it is possible/necessary to file taxes jointly if the spouse is currently out of US and does not make any taxable income? Also I’m a us citizen and I just got back to US after living a few years with my spouse in Sri Lanka and I got a job offer here which makes over 150% on federal poverty guidelines and since I haven’t filed any taxes while I was living in Sri Lanka (because my income in SL was too low to file taxes)  How do I prove that my income is sufficient and will continue to support my spouse & he will not be a public charge?

That's a fairly common question. You will have to produce an employment verification letter, a few weeks of paystubs, perhaps some bank statements to demonstrate that although you don't have past tax returns to show income, currently you're employed and earning above the minimum threshold. Get some work history (perhaps 3 months) before you attempt to sponsor your partner with your I-864. Or you can use a joint sponsor (if applicable).

I learned the hard way, I hope YOU don't have to. Advice: learn, learn, learn.

Interview: December 6, 2016 London

N-400 filed: September 30, 2019

Interview: March 22, 2021 Seattle

Oath: March 22, 2021 COVID-style same-day oath

 

Now a US citizen!

One pay stub is sufficient evidence of current income and employment.  No need for employer letter if you have a pay stub.  No bank statements unless showing "assets".  

 

If your income was below the filing threshold during all three prior tax years, simply hand write, "Income below filing threshold" next to where you'll enter the years and zeros on the affidavit.

Facts are cheap...knowing how to use them is precious...
