Wrong Divorce Date on Marriage Certificate. Help!!

My husband and I are starting the CR-1 visa process. However, when we got married, I put in the wrong date of my divorce. I put in the month we filed, not the month the judge signed the paperwork, so I was off by three months. Because the marriage certificate displays the incorrect date, do we need to get this corrected before we submit our application, or will the divorce decree and noting in the correct date on the I-130 be okay? We already contacted the issuing agency to get this corrected, but this will add an extra month we are apart to correct. In New Zealand, the divorce date is fine not being correct as long as I was legal to marry again at the time we did, which I was, but we are stressing to the agency that it needs to get corrected. Has anyone have had his issue? I will try to contact the USCIS Monday morning too and ask, but getting impatient and thought I would try here first.

If the I-130 has been approved, then you're fine. The consulate will want to see the original certificates anyway during your interview process, and you'll need to upload them to the NVC. I haven't seen any issues around here because of minor misdating. You have a reasonable and valid explanation too, so I wouldn't worry at all.

So we have yet to snd out our I-130. The only thing holding us up is either waiting to get it corrected or risk getting an REF causing more of a delay. Yes, we certainly have all our original documents and are getting them uploaded that do show the correct date. We are just worried when they cross check the date from the marriage certificate and the divorce decree, they will make us correct the marriage certificate and then send it back.

well if you haven't sent in your I-130 yet, fix your paperwork, print out a new sheet and fix the date. If you can fix anything, fix it now. If you already sent it in, wait and see or send an inquiry regarding the issue.

Enter the correct date the divorce was final, where asked on the I-130, and provide a photocopy of a certified copy of the actual final decree.  Typically, marriage certificates don't mention prior divorce dates, so they will not really care if the dates match, as long as you were free to marry when you married.

Facts are cheap...knowing how to use them is precious...

Ok cool. That is what I was thinking. I find it quite odd that the divorce date is on our marriage certificate as well as our occupations. I wanted to hang our certificate in a frame but not with divorce information on there. Also, what if our occupations change? It is really weird that it has all this information on it. We are just going to send it as is while still working on getting it corrected so we have a corrected version just in case.

Different countries, have different ways of doing things.  Occupation of parents tends to be on birth certificates and occupation is on death certificates. In the US, this varies by State.  Worldwide, it varies widely.  It was clear from your facts, that it was a US divorce and foreign marriage, even though you didn't say so.

 

Facts are cheap...knowing how to use them is precious...

Yep, a US divorce and remarried in New Zealand. I absolutely loved it there and even brought my dog there. We only are moving because I have a severe medical issue that needs attention and need to be close to my doctors as the doctors in NZ are not that well versed in my condition. Thank you again for providing us a more positive outlook! Our CR-1 visa countdown is about to begin!

I just got off the phone with a USCIS officer. So if anyone happens to be in the same boat, it is best to ammend the document and THEN submit the I-130 when all dates are correct. Even with a letter explaining the error, that may not be enough and could risk being questioned which would delay our application.

I am not too sure which tier I spoke to. I had to go through a lot of options in the automated system to finally be connected to someone. Because it is only taking 15 days to amend our marriage certificate, we are just going to wait it out and then submit our I-130.

If it was the first person you talked to, it was a tier 1.  Basically a call center representative from what we lovingly (LOL) call at VJ the Misinformation Line.  Take what they say with a grain of salt.

Haha!! Thanks for the heads up! Definitely keen to wait 15 more days to make sure all of our ducks are in a row. I try not to think about it as an extra 15 days being apart even though that is very hard!

I suspect you talked to a know nothing call center agent who was speculating.  If you can correct it in 15 days though, why not do it.  Since there are no questions on the I-130 about the divorce date that appears on your marriage certificate, but only about the actual divorce date, it is definitely a non-issue.
