**Working while waiting for EAD??**

I 100% know that we have 50000 different posts and debates for this...but it all still seems to be a little confusing. I am not looking to debate, just someone looking for some information here.

 

My husband has been doing side jobs since he arrive here on a K1 (I make enough keep us just fine), but he has been helping this guy's company randomly with a few jobs here and there. it gives him something to do and earn a few dollars. He hasn't earned anything crazy, somewhere close to 200 bucks a week or so. He only gets called in a few times a week for an opportunity to go somewhere with the owner who is a family friend. We are just now getting his EAD and can finally actually apply for a job. The owner of the company though asked if we would like a W9 for his side jobs....I am pretty sure that we cannot do anything with that right now correct? Has anyone dealt with this?

I wouldn't.  Until he has a valid EAD, he is/was not authorized to work........enough said....

In all honesty, IRS couldn't care less about immigration status or lack thereof as long as they get paid what they are owed. For the company that hired your husband's services, things can get nasty if they are ever caught hiring the services of someone who is not authorized to work. For your husband? Hard to tell, but what we know for a fact is that the choice to work without an EAD comes with a price. It means that at some point of his immigration journey, on the many forms that he will yet have to fill, he will either have to admit he broke the rules by working without permission or lie about it (which is always a poor choice), with or without a W9.

 

I think that advancing this "debate" is against VJ's ToS, but I guess it's up to the mods to make that call.

Don't do it.  We had someone that was denied at citizenship years later because he had worked off the books and did not disclose it when asked in previous interviews..
