Hi all,

After sitting around for just over a year waiting for my PD to be current (1st Nov. 2018), I am hoping I should taking the next step when the next VB is published.

What should I do next? I still need to get the medicals completed. My children on also on my application and will be over for a week in January for their biometrics. From experience could we complete the medicals in 7 days (we are all from the UK and they have not visited many countries outside of the US and Europe) so I can get all that out of the way in one trip?

Finally, is the interview already scheduled at my local office but I will not be told until my PD is current or is the PD being current the system trigger to send the package to the local office?

Tks

To file 485 package - PD needs to be current

To get Biometrics done - USCIS discretion based on where they thin PD will be in 6-12 months . if you PD falls within their estimate they will complete biometrics and interview

To get interview done  - USCIS discretion based on where they thin PD will be in 6-12 months

To get 485 adjudicated/ approved - PD needs to be current

Thanks for the reply. Perhaps I do not fully understand this process (still).

Dates for filing have been in place for a few months that met my PD, thus we filed. Biometrics appointment arrived and case status show fingerprints attached to cases.

If my understanding from your reply is correct the interview could be anytime now and once the PD is current, someone from USCIS will look at the I-485?

Which visa do the children have?

I don’t understand what you mean by children are flying out for biometrics. If they are not currently resident in the US they need to get a derivative visa at their home consulate to enter. They can’t fly in on a tourist visa with intent to adjust (and if they are on VWP they are explicitly prohibited from adjusting status).

My children already have L2’s.

they are just spending sometime with their mother in the U.K.

No tourist visa involved.

With the greatest amount of respect and I value every reply and in essence, I agree with you, however, the question I asked was what happens next in the AOS process and could we complete the medical in 7 days to get that out of the way.

I was not even aware a biometrics appointment would be issued for the children if their applications were not in order, perhaps they would which is why you jumped to that conclusion.

The only reason I “jumped” to any conclusion is because biometrics in the US are scheduled for people that resident in the US, and so it is not usual for any derivatives to “be over for a week in January for their biometrics”.

If you list children as derivatives in your application then of course they will schedule them with you, if something isn’t in order you’ll find that out at the interview.

Thanks again for all your replies. They all provide great insight.

Would you have any thoughts on the medicals? Is 7 days enough to complete or do i need more time?

Best person to ask is the doctor you plan to use.

I assume a medical will take place on one day so 7 days is not needed just that they are here on the day of the medical.

Over for a week? So they don’t live here? They have been using the L-2 status just to visit from time to time?

Good luck.

They is no requirement for a L2 to live in the US, they are not permanent residents.
