JANUARY 2020 K-1 NOA2 to NVC to EMBASSY

Public Charge form DS-5540

 

It has been reported that a CR-1 visa applicant at their interview yesterday was requested the new DS-5540 form. As the applicant did not have one, he was put on AP and requested by way of a 221(g) to complete one and return it to the embassy. Once received the entire case will be adjudicated to an outcome.

 

Since I can't say if this is true for K-1's, as I heard, they were exempt if they had filed before Feb 24th. Since this is so new and so many speculations are whirling, we will hear different stories until the dust settles. 

 

This is all I know. I'm not going to be able to answer any questions because we and I don't know what the requirements are and how each embassy is going to handle this. I recommend that you get a copy of the form and have it filled out for the interview to circumvent any delay.

Just want to double check if I'm doing the right thing. After receiving the NVC case number I went on to the ceac.state.gov and went on the DS-260 create application link. After entering the case number and the invoice number I have received this message:

Am I supposed to fill out DS-160 now or do something else?

 

Also, once I went on Visa Status Check this comes up:

I have never received any instructions from NVC

I have never received any instructions from NVC. For the K-1 you will not receive instructions as the instructions come from your embassy.

For the K1 Visa you complete the DS-160 not the DS-260.

I have never received any instructions from NVC. For the K-1 you will not receive instructions as the instructions come from your embassy.

I'm not really sure where to add this bit of information but it was very helpful for me regarding insurance for immigrants in the US. I have been searching the web, asking multiple forums and making several calls trying to figure out if my fiancé would be able to use the Marketplace to shop for insurance on a K1 visa. This article from healthinsurance.org answered all of my questions and some. Hopefully this information will be of use to others with the same questions.

So I completed the DS-160, but am not able to go and pay the fees online. This is the message they give me:

Notice: Payments with a current status of "In-Process" are taking longer than expected to reflect final payment. This issue is currently being investigated.

Your not doing anything wrong. The message tells you it's a system error on their part and they are trying to remedy the situation. Wait a day and try again.

I confirmed that NVC has my application and have assigned it a case number, now I just have to decide if I should ask my fiance to start the DS-160 or wait since the application won't be sent to the consulate until the situation in China is clearer

I'd wait. There is nothing that requires you to finish it except to secure an interview date and it sounds like you are going to sit pat for awhile anyways.

The Canadian P3 requests "certified translations" for foreign documents. Can my fiancee and I translate the documents ourselves, or do we have to pay someone to translate and "certify" them?

 

Also, would a police certificate from more than 12 months ago still be valid if my fiancee has not returned to that country since before the PC was issued? It is not the country of her nationality, but a country she studied in for a semester in college.
