Good day guys, i have a few doubst related with documentation, I read that i could get my Nulla Osta (free to marriage from UNCHR), since i Can´t contact any office from my country, my birth certification could i use the Baptism certification?, Police records I guess only can request the one from Italy, and also for my Vaccination...is better put them all?....someone as same case as our already sent the documentation?, if anybody has recomendations please feel free to contact us...

Your post is a bit confusing and I’m not sure where you are in the process. If you are looking for a document that says you are free to marry- all you need is to write a statement that you are free to marry. If you’ve been married before will need divorce decree- but I’m assuming you’ve never been married. 
 

what is your birth country? I’m unsure what to do about getting a police report from there- maybe there are other refugees who can chime in.

 

Are you stating that you do not have a birth certificate?

 

Vaccinations- if you don’t have your vaccinations record that is not a problem they will draw titers and from that will know what vaccines you need.. but this is at the end after your petition is approved.

Good Day, yeah sorry for the missunderstanding

We are Recolecting the documents for I129 in this moment, I am from El Salvador, I am a divorce, with one kid, my kid lives with my ex wife, Taina also is Divorce too, I am a refugee in Italy since 2017, my document expires in 2022. i have all the documentation to be ok here in Italy (Residence, Travel Document(Passport), Id) .

according to my document i can not contact any office from my country, if i did i can lost my protection, so that´s why i was asking about my Birth Certification, my Divorce Decree, My Card Vaccination and my Police Records

as far i know most of the documents i need to go to UNCHR, but if anybody already do it, and how was their experiences

I don't know what UNCHR is, but all of those documents will absolutely be required in order to have the petition approved, regardless of your refugee status in another country.  USCIS will not just take someone's word for it that their divorce was final and that they are free to marry.

Travel document (Titre de Voyage) which has a green cover is a courtesy travel document issued to those other than refugees, usually stateless persons, who for any reason cannot obtain a passport from their government. Both documents are valid for one year and may be renewed annually if the bearer maintains the same status. Documents must contain an Italian reentry visa stamp whenever the bearer travels abroad. Both of these documents are considered to meet the passport requirements of the INA."

Please keep in mind that there are documents that are required when your US petitioner files the I-129. Others will be required after your petition is approved and you get to the interview stage. We were never asked for Nulla Osta at the I-129 nor interview stage. They'll asked for certified divorce certificate if either you or the petitioner were divorced. They also asked for police certificate in English or Italian from any country you lived in for more than 6 months but we were asked for those at the Napoli consulate interview, not at the I-129 filing stage. You can get any vaccinations you're lacking at the time you do your medical but as I understand it, vaccinations are not required for the K-1 visa since it isn't an really an immigrant visa, non the less, they are not required at the time you file the I-129. Not sure if they'll accept Baptism certification. Other members may have to chip in.

OP will still need his divorce decree.

I’m sure they will.  I was pointing out that the requirement for any of those documents will not be waived due to refugee status.

Hi! First of all thanks to @qrk for linking my post.
Since you're at the I-129f stage the only concern for now is how to obtain the divorce certificate from your country. That is absolutely required in order to file the petition, cause it falls into the "Must be legally free to marry" requirement/definition. As other suggested already, the only option I can see it's to contact the nearest UNCHR office and ask them for assistance. I've never needed a nulla osta as proof of being legally able to marry. A simple letter of intent to marry is enough (you can find a sample here https://www.visajourney.com/forms/examples/), along with the divorce certificate from both parts, obviously.
As for the other documents, you will need them later, once your petition is approved.

Regarding the Baptism certificate, packet 3 (sent after the NVC receives the case) states:
Unobtainable birth certificate: Your birth record may not be obtainable because, e.g., your birth was never officially recorded; your birth records have been destroyed; or the appropriate government authority will not issue one. In such a case, please obtain a certified statement from the appropriate government authority (again, UNCHR might help) stating the reason your birth record is not available. With the certified statement you must present secondary evidence such as: a baptismal certificate that contains the date and place of birth and both parent’s names providing the baptism took place shortly after birth, an affidavit from a close relative, preferably the applicant’s mother, stating the date and place of birth, both parent’s names, and the mother’s maiden name. An affidavit must be executed before an official authorized to take oaths or affirmations. Information regarding the procedures for obtaining birth certificates is usually available from the embassy or consulate of the country concerned.
As you can see, it can only be used as secondary evidence, I don't think it can be used to completely substitute the birth certificate.

Vaccines: (for the interview only) If you can't obtain the vaccine records from your country, I suggest you schedule a doctor appointment and ask them for IgG antibodies blood exams for each disease as proof of immunization. The presence of antibodies in yor blood will determine if the vaccine has already been administered in the past or if you have already contracted and defeated the disease (as happened to me for Varicella). Another alternative, but way more expensive, is to get the shots at the medical visit the day before the interview (I assume you'll go to "Istituto Diagnostico Varelli" in Naples). The important ones are  measles (morbillo), mumps (parotite), pertussis (pertosse), rubella (rosolia), influenza and chicken pox (varicella). I don't know how old you are but I doubt you're over 65 😄 so you're good with the ones I've just mentioned.
