Extension of Form I-797 NOA2 (with missing application?)

Hello,

 

We have received our NOA2 on 24 July 2019.

 

However, NVC have not yet received it, and they are currently working with USCIS to figure out where it is.

 

Would I need to request for an extension of the I-797, which is due to expire soon? And if so, how might I go about this? I sent an e-mail to the embassy in London, but I have also read somewhere that this may be done automatically. Should we need to worry too much, considering that they might have messed up somewhere and delayed it? We shouldn't have to be worried that our application be binned if they say that we didn't want to continue with this process, as during this time we have tried to find out what the status and progress have been.

The tardiness of your approved visa petition arriving at the embassy is obviously beyond your control. I would certainly hope that they would extend the validity date of the petition as a consequence of their foul-up. Just keep their feet to fire, and in finding your petition. You did make a copy of the petition application prior to sending it to USCIS, correct?

Thank you. We have sent emails and made calls and the NVC is working with USCIS to figure out what’s going on, but that was over two weeks ago. It’s getting urgent now, because we fear that our application might be terminated. We are at least after some reassurance that it will be extended until they tell us what the situation is. As for copies, there are two exact replica copies of what was sent, so if we do have to go back, it won’t be too disastrous.

No need to extend it. From your embassy's webpage, K1 instructions, interview documents page https://uk.usembassy.gov/visas/fiancee-2/required-documents/

 

If your petition expires before the visa interview takes place, you are required to bring to your interview a signed letter from your petitioner confirming that you both remain legally free to marry and that you will marry within 90 days of your arrival in the United States.
