Really need your help on this...hope someone with similar experiences can answer.

 

We are applying for the CR-1 visa from Singapore, and both of us currently live in Singapore, we just submitted all the required civil and financial docs together with the D-260 form on CEAC. 

 

And as we want to move back to US, my hubsband (US Citizen) is looking for the job now and want to relocate back to US. 

 

So my concern is, if he gets the job and needs to move back to US before my interview, will it have any impact during the interview?  The employment information we provided on the D-260 was for his job in Singapore and so if he were to change jobs, that would mean there will be misalignment from the job info that we provided to NVC.  Can we just mention this to the embassy consular officer during the interview and will they ask for any additional documentation?  If additional documenation is needed, will they issue a 221g or will they accept the documentation on the spot?

No, in fact, that is great for your interview. One of the requirements is the US citizen must have domicile or intent to establish domicile in the US and by him moving back, that piece is done.

No a problem at all. Things change. Things are allowed to change. You can't "freeze your life" after you submit documents to the NVC. Just mention it at the interview.

If you have it right there, you can give it to them. Plan to bring documents from his new job such as the offer letter with salary listed, pay stubs if he has it. That's about it.

No he is the sole sponsor.  What should I say during the interview?  That he previously worked in Singapore and had already moved back?  Will I have to provide any additional documents during the interview?

You need an updated I-864.

 

Unless his job from Singapore was continuing once he moved to the USA he couldn't use that income anyhow.

You will need to have a Joint Sponsor who will file a separate I-864.  

 

Your husband's income will not count for the I-864.  His current income will stop when you both go to the US, so it's not countable for the I-864.

Thanks for the info!  Will they review and approve the documents there or will they ask us for a 221g and to reupload it on the CEAC website?  Just want to try to minimize any delays in the process.

On the I-864 form, we also filled in the asset requirement and not just income.  Given that, do we still need an updated I-864?

If the items on the I-864 has changed then yes.  

 

Aka if he's domiciled in the USA instead of in Singapore. 

 

Your assets help you, but the income was inconsequential.  So unless the assets are 3x the income you'll need a joint sponsor a US based job or a qualified joint sponsor.

Your husband moving back to the US is not a problem.   This is not going to cause any delays.

 

You may need to get a Joint Sponsor.  Not having one may delay your case.  Some embassies don't consider assets.

They will review and approve there at the Embassy. 

How it works is: The NVC is basically a documents depository for the Embassy/Consulate. Their job is to receive all the documents submitted (police certificates, the birth certificates, ...) and make sure everything is in order before the file is sent to the Embassy. They don't approve anything. They're just glorified documents organizers. The Embassy has the authority to approve the case.

 

For example, when I sponsored my Mom, in between the NVC and the interview, I had another baby. Obviously I knew there was a baby on the way, but when I filled out the I-864 for the NVC, I can't put her on it, because she wasn't born yet. Then at the interview, I had to account for her otherwise it would be inaccurate calculation so I just filled in a new I-864 and submitted at the interview for my Mom. I just told them "Here's a new I-864, please use this one" . No big deal.

The assets are more than 3x income so that shouldn't be a problem.  So do i need to submit a new I-864 during the interview?

I would say yes, if things have changed and items on the I-864 are no longer accurate and you need to submit a new one.
