Hi. I am the beneficiary. We hired a lawyer to process our petition and we already got approved. Our case is already at the US embassy and I can already schedule for my medical and interview. However, when we asked the lawyer to send us the copy of I129f, I saw some errors. I have no children but the box was ticked that I have. Also, my passport details are blank. We are worried that this will affect the interview process. Any thoughts on this matter, please? Thank you!

Police records. I’m disappointed with the lawyer because my fiancé paid a huge amount of money. We submitted police and court records (all dismissed) but he only sent the court records, hence, rfe. He’s an immigration lawyer and he should know the requirements. And I think he didn’t even review the I129f form. 🤦🏽‍♀️

Please take a look at your I-129F page 6.. Right there, it's written "If your beneficiary is currently in the United States, complete
Item Numbers 38.a. - 38.h." So your passport number isn't necessary. Now the homework is just the children matter.

Passport detail are only needed IF you are IN the USA currently.

 

Don't worry on the :oops:  by the lawyer regarding the "yes" box.   If asked about that at the interview, simply state you hired an attorney and he screwed up ... ;)

Pretty poor work by the attorney there. I'm always amazed how they manage to get these things wrong, its a pretty simple question.

 

I think its clear from the "no children" written underneath that the wrong box was ticked. Person reading the form probably assumed that and didn't issue RFE on that point. I recall I had one part that I left blank that I should have filled in... I think it was "have you ever visited the US?" I hadn't answered it, and it was circled on the form by whoever processed it, but below I'd detailed trips to the USA, so I assume they realized I'd missed that box and processed it as if I'd ticked yes. I never got an RFE - I think they try to use their common sense if they can when processing these.
