Tax filing extension expired.

I filled for extention for 2018 tax year. Went to IRS they said have to find joint since married, but my wife doesn't have SSN not being in the US. My tax extension expired on oct 16, 2019 but VISA interview is on Nov 21, 2019. Is that going to be an issue?

You can file married separate,  wife doesn't need SSN.

Thats what i thought, but the IRS lady seems to disagree. I was trying to find out is this will be an issue at embassy. I do have a co-sponsor though.

The IRS told you this?  It is absolutely incorrect.........But I would file asap.....married-filing separately-----

August 7, 2022: Wife filed N-400 Online under 5 year rule.

November 10, 2022: Received "Interview is scheduled" letter.

December 12, 2022:  Received email from Dallas office informing me (spouse) to be there for combo interview.

December 14, 2022: Combo Interview for I-751 and N-400 Conducted.

January 26, 2023: Wife's Oath Ceremony completed at the Plano Event Center, Plano, Texas!!!😁

February 6, 2023: Wife's Passport Application submitted in Dallas, Texas.

March 21, 2023:   Wife's Passport Delivered!!!!

May 15, 2023 (about):  Naturalization Certificate returned from Passport agency!!

 

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

Worst place for tax advice is the IRS itself.   Even @missileman is a better tax advisor than them

 

Whether it is an issue or not depends on the consulate and what they want to see

Your Not filing could be an issue..........You should file whether you have a joint sponsor or not.

Just wanted to let you know that on my 2018 taxes i put single even though I recently got married. I thought it would be a problem but lots of personal friends and family said not to worry. Hubby went to his interview and they didn’t even say anything. I wouldn’t think to hard on it. If you can get it to say married filing separately then great but if not I doubt the embassy will care. They didn’t mention any of my financial documents when he went to interview. Approved right away. Best of luck.

This just gave me hope because time was running out on my husband when he tried to file a w7 for a itin for me but was later rejected so he just went ahead and file single... base on research he has three years to amend his status on the tax papers to prevent a audit but just wanted to makes sure that filing single isn’t a grounds to deny the visa

Technically if someone is married on the last day of the tax filing year, whether in America or abroad, the taxes should say married filing separately and using some other number (idk from where) instead of the spouses SS# since it’s not even given at the time of filing. I was so worried and didn’t want to comment till hubby got the approval. So at least for the embassy in Dhaka, they didn’t mention it nor ask questions. Some might say that’s wrong and I should have done married filing separately but I didn’t and had no problem during NVC stage nor the interview. I can’t guarantee that all embassy’s are like that. They might want to see it as proof of relationship, showing that the petitioner is filing married instead of single. Hoping for the best for you!
