I would like some information on the new health insurance policy that will go into effect nov 3rd does anyone know how can a spouse add their husband or wife on their insurance if he or she is living out of the USA. Or is there another way to show that person will be covered by health insurance before going to the USA

I plan on requesting a letter from my employer or employer supplied health insurance company stating that I will be able to add my husband upon arrival. It's my understanding that you need to prove that the beneficiary will be able to obtain health insurance, so my thought is that the letter should be sufficient evidence of that.

Many members have added their spouse to insurance before their arrival or immediately afterwards. An SSN is not a requirement, but unfortunately some do encounter resistance via the ignorance from HR representatives. You need to ask and push upwards if needed.

first of all this was tried in October and 2 federal judges overruled it

next it has always been a part of the "totality of circumstances "  that a CO must review to make sure the petitioner can handle the cost of the new immigrant

 

that being said with the cost of health care being one of the major living expenses we all face,  the CO will be closely looking at the income of the petitioner

 

and for a CR1 immigrant that can work as soon as he/she finds a job so he / she may be able to provide their own health care  unlike a K1 visa receiptant

 

have any of you contacted local insurance companies and gotten a quote?

or quote from your health care at work to show the cost of adding the spouse?

You may already be paying for family policy (if you have chlldren) and there may not be an increase in the premium

Check it out

 

To me that would show seriousness intent to provide the needed policy or changes by your health care provider

Regardless of whether the policy takes effect or not, it's wise to add a spouse as close to immigration as possible (before or after).  Not all insurance companies handle it the same way.   For me, I was not able to add my husband until he got on the plane to fly here.   By immigrating, my husband automatically lost his existing health insurance.  So the qualifying "Life Event" to add him wasn't our marriage (since he was overseas) and wasn't the immigration, it was that loss of insurance.  Even then, my HR benefits department hounded me until they received his SSN weeks later.  

 

Had I been in this new policy situation, I would add him to my insurance while he was flying here, do a PDF of the webpage showing he was added and emailed it to him for evidence which he would have on his phone for CBP.   

 

You need to call your insurance company or HR benefit line and ask a lot of questions.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).
