RFE Help

Hi everyone. 

 

I've recently received an RFE on the I-864 side of things and hope someone can help somewhat. 

 

They have said they want a signed and completed form as well as the social security number which I 10000% supplied? Is this some sort of ploy to confuse or just delay things? They have asked for the household size to be correct, I have put 2 for my self and my husband? My mum is the  joint sponsor  and her form is 3 as she has a daughter? Am I just being a moron? haha! They have also asked for my most recent taxes which I don't have as my taxes for this year were rejected and I failed to fix and file within the allotted time so I decided to take the fine on next years, can I explain this in some sort of cover letter? 

 

Finally, will they want the form to be re-done with the information correct at the time of application or correct as of today? The reason I ask is that since I applied I've had a baby (which they knew I was having) so that would also mean various bits and pieces across the i130 and i485 would need adjusting too as well as the household size on the i864? 

 

Please no keyboard warriors or smart arses just plain friendly advice!

Are you saying that you have not filed for tax year 2018?

Essentially yes. My taxes were rejected and I failed to amend and file in the allotted time so I'll be fined next year.

You have to file your 2018 taxes....you can't explain it away in a cover letter...you can file now.  It will be late, and you will pay some penalties.....but you will have proof that you filed....

plain and simple

you need to do those tax returns 

you would be surprised at how fast the penalty and interest add up 

interest is computed on a daily basis

on the friendly side Congratulaitons on the new baby

Yup, need to have filed for the past 3 years to be eligible as a sponsor. Get that in.

 

The I-864 would need to be accurate as of the time you fill it out (now), not at the time of the original filing. So a change in household size, income, etc. would be reflected.

Are you claiming your husband twice on the I-864? You have to add daughter as it is a household change. Other than tax transcript what are the documents u submitted for proof of income?
