JOB TERMINATION- HOW TO DEAL WITH THIS?

Probably the last Update to this thread. Grab your popcorn

Meeting was virtual.

 

So we had a EEOC meeting. The company's lawyer comes in and has nothing prepared because he already knew he was gonna win this as its a black against white case. I kid you not, the guy said  " I am not even gonna go through the specifics blaa blaa blaa." Yes, he kept on saying blaa blaa blaa. Immediately, I knew this guy and his secretary did not bother to understand the case because he knew he was gonna win it anyway. He only put forth 6 baseless points which are:

  1. That I was observed to be in social media 24/7 - 🤨#######? Yes I do have FB, Twitter and Instagram. Last I logged in was the day I got hired at the company. Over time, I came to find them boring. I even told the mediator that she could contact FB and ask them for my login activity. 
  2. It was observed that I used the company phone for personal call and my wife called me on it - I did not even have a company phone. We had a desk phone which I only used 3 times the whole time I was hired. All company desk phones were eventually removed a year after my hire. Infact, one of my colleagues - let's call him Jason, who was also one of my accusers, used to laugh at me and ask me why I have an office desk phone that I have never used. 
  3. That my wife was in school and this was a distraction - Really? My wife went to school and minded her own business. They knew she went to school because I mentioned it during small office talks. Furthermore, when did a spouse going to school become a problem for the employed partner? Additionally:
  • My supervisor's wife (let's call him Peter) was in dental school. I swear when I say that this guy was always on the phone with his wife. Surprisingly, this was okay and not a problem. However, those who are not on the phone with their partners got fired and accused. 
  • Jason's wife called daily too and the two would spend time on the phone.
  • Peter and Jason are the greatest chameleons I have ever met. I walked in the office at 8am and the two are always chatting. But since they were white and superior than me, they got protection.

      4. That everyone loved me - then why was it a surprise to all those who loved me that I got fired?

      5.The company was laying people off because of COVID19 - How is this even here? My story happened last year. By the way, I have an insider who told me only 3 people (less than                2% of branch population) were let go. So this lawyer was making it look as if the company was doing massive layoffs.

      6. That I used Google to search answers. First of all, when was researching a problem? Shouldn't it be positive that I am being solid. Second, if I asked Jason for answers, he would              refuse to tell me and then tell me to go research. If I did research, he would say I am wasting time. Either way, research or not, he would write to Peter saying I am lagging behind              in development. So it was a never ending circus with him.

 

It then gets better. The company lawyer had mentioned that the company has tonnes of evidences. #######? Seems I was being investigated all while I was at work and was never formally told. Anyway, he sends (emails as this meeting was virtual) the evidence to the mediator. It was about an episode that happened 4 month prior of which Peter had written to the VP stating that he observed me the whole day on my phone. So if he did, that means he did not work too, right? So what was his work output for that day? 🤨 Anyway, their "tonnes" of evidence ended up being a single day email communication between Peter and the VP. I asked the mediator if he sees my response within that email. She said no. So the company took out my piece and sent "evidence." 

To catch you up to speed with the above. This issue happened in February of 2019. I got attached to the email chain accidentally by the VP. That is when I came to know about what was going on. I responded, with evidence,  refuting the claims. So when they sent this out to the mediator, they took out my response. Anyway, the VP later had a talk with me, all because I intercepted the email, and apologized and said it was a miscommunication. Now thinking back, with the evidence that I submitted when I replied to the email, they realized I could sue them for defamation of character. So VP came out and cooled the steam and told me not to worry about it. How naive was I. Anyway, this was the "tonnes" of evidence that the company lawyer was taking about. Pathetic.

 

Even more interesting, the company lawyer mentioned that the company WOULD have laid me off during COVID19 pandemic had I survived last year? This arrogant guy....So we asked how he was certain? Realizing he just shot himself on the foot, he said that's not what he meant all while re-wording and still shooting himself on the foot. Anyway , he got away with it.

 

Anyway, my attorney just told me to accept the peanuts being offered by the company. The mediator too kept on pressing me to just accept and move on. So I did, settling for 10% of what I was asking. Additionally, I had no solid evidence because the company made sure as to give me a surprise termination. So the arrogant lawyer knew this and that was why he never even bothered to prepare for anything. That is even why he was bold and told me I would have still been fired during COVID19. Seriously, does any of his points, mentioned here, look like someone who came prepared? blaa blaa blaa is what his arrogant self kept telling us. He actually said "blaa blaa blaa."

 

Such a racist company. The end

Thanks for returning with the update.  It stinks, but 10% is better than nothing.  You're free of that place, and you can be glad, given the caliber of people and organization that they are.

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).
