EAD extension or AOS expedite request?

Hello there,

 

Three months ago I had the interview for my green card. So far my status did not update. My EAD card is expiring in November. 

I am not sure if I should request an extension for my EAD card or request an expedition for my AOS?!

 

Also, with the expiration of my EAD card, my drivers licence will expire too since its a temporary one.

Renew.  Upon receiving the renewal request,  your EAD will be automatically extended which you should  be able to use to extend the dl

The I-765 receipt notice will auto-extend your EAD till May 2020: https://www.uscis.gov/working-united-states/automatic-employment-authorization-document-ead-extension The renewal is free; include a copy of the I-485 receipt notice.

Thank you! Does that mean that I have to resend the I-765 form with the copy of the receipt for the I-485?

Keep the one USCIS sent you; make a photocopy to send in with the I-765.

I forgot to clarify that only the EAD part will auto-extend. The AP part will still end on 11/17/2019.

And that is all I have to send in? No need for passport-style pictures or copies of marriage cert, passport, birth cert, I-94, etc? And am I filing under category c9?

And I can send in both, EAD and AP renewal at the same time?

 

I called USCIS today and they told me to apply for that 60 days before my combo card expires. I did not know that I would have to file for this since I had my interview three months ago and I was kind of expecting my GC soon. So I am filing for this renewal a little over 30 days prior expiration. Does this have any effect on my pending AOS? And, will a renewal be approved quicker? Just worried about my job.

That is what I sent for my EAD/AP renewal. My renewal timeline:

12/28/2018-Submitted I-765 with I-131 for free EAD/AP renewal

05/13/2019-Went to I-485 interview. "Your case is being held for review."

05/23/2019-Date of I-485 RFE

06/04/2019-Expiration date listed on initial EAD/AP (EAD part automatically extended till 12/01/2019)

06/13/2019-Local field office received my RFE response (according to USPS). Online case status doesn't reflect that; online case status still says "On April 4, 2019, we scheduled an interview for your Form I-485."

08/02/2019-I called USCIS about the pending I-765 and I-131 being out of processing time. They submitted a service request; officer still hasn't been assigned to the service request.

09/09/2019-I called USCIS again about the pending I-765 and I-131. They submitted a 2nd service request.

09/10/2019-I submitted a request for case assistance to the Ombudsman for the pending I-765 and I-131.

09/18/2019-I received an email from Ombudsman. "The Ombudsman's Office has reviewed your request for case assistance and contacted U.S. Citizenship and Immigration Services (USCIS) regarding your application/petition."

09/19/2019-Officer was assigned to 2nd service request.

09/23/2019-I-765 was approved

09/25/2019-I-131 was approved

I didn't send in the passport pictures with the renewal. But to be safe you can include the passport pictures since it's listed in the instructions: https://www.uscis.gov/system/files_force/files/form/i-765instr.pdf Page 20

I got my EAD (combo) card 2days ago and realise that uscis printed a wrong "country of birth" on my card. I already mailed it back to them with necessary document for correction.

Please is there anyone with the idea of how long its going to take for them to correct it and send me back my card?

New I-765 form

That is all you need.

The receipt you will get serves as an automatic 6 months extension of your EAD.

EAd renewal does not affect your AOS at all. No it will not be approved quicker. The earlier they receive it the better for your job security because then you will be in line for the renewal and you have less chances to have to leave your job.

Because if by the end of the 6 months extension  (really hope that doesnt happen to you but I rather you know what to expect) if  you still have not received your GC or renewed EAD you wont be authorized to work anymore.

07/11/2019: I-485 approved without new medical exam

I sent everything off on Saturday. So, as soon as I will get the receipt notification the EAD will be automatically renewed? Do you know if I will be able to extend my drivers lisence with this? Because that expires with the date of my current EAD card.

If you encounter issues with your employer, then refer them to the Handbook for Employers (M-274):

Florida DHSMV employees should have access to an internal manual called "Acceptable Document Table." The 07/19/2017 edition: https://web.archive.org/web/20170830071436/https://www.flhsmv.gov/ddl/aila/acceptabledocuments.pdf Page 10 "If the EAD card is expired, a license or identification card can only be issued if the customer provides a receipt notice (I-797 for I-765) showing they applied for a EAD renewal prior to the EAD card expiring."

Page 17 is also interesting "I-797 for I-485"

Yes it is automatically renewed I think it even says it on the receipt.

I live in Maryland and used the receipt with no issue whatsoever to extend my DL for another 9 months but since it is a state thing you will have to check for your state hopefully it is similar
