We are at NVC stage uploading civil docs on CEAC. Beneficiary is asked to submit:

- marriage certificate (1st marriage- final divorce decree)

Beneficiary was married before, the marriage terminated through divorce.

So what exactly we need to submit, marriage certificate of that previous marriage? Or divorce decree of that previous marriage? or both?

Please advise! Thanks!

Your current marriage certificate and the divorce decree from previous marriage(s)

After you collect your financial forms and supporting financial evidence, you and each family member immigrating with you to the United States should collect the civil documents that are required to support your visa application.

 

 

If you are married, you must obtain an original marriage certificate or certified copy.

  • Send a photocopy of your marriage certificate to NVC.
  • Bring the original marriage certificate plus a photocopy to your visa interview at the U.S. Embassy or Consulate.

 

If you were previously married, you must obtain evidence of the termination of EVERY prior marriage you have had. Your evidence must be an original or certified copy of one of the following documents:  FINAL legal divorce decree, death certificate, or annulment papers.

  • Send a photocopy of your marriage termination document(s) to NVC.

Thank you, Hank! So you think they want a proof of divorce?

The wording from NVC is confusing because there is a difference between a marriage certificate and a final divorce decree, they are different documents.

The NVC clearly wants the document of the previous marriage, but which one ? of marriage or divorce? As we only have it’s divorce decree. That marriage happened 30 years ago in a different part of France, and it will take time to obtain the proof from the marie. Also, there a strike of transportation workers right now which will further delay the process😪

We are submitting docs to NVC through CEAC. Beneficiary has 6 children, but only one immigrating with him (CR2 visa).

We are submitting civil docs for my French husband (CR1 visa) now. The birth certificates of children are not required by NVC, but Embassy in Paris has those on the list for the interview:”Bring originals of birth certificates of ALL children even if they are not immigrating with you”. 

Do you think we should submit those through CEAC now, too to avoid a RFE?

They state that they want all divorce decrees for any previous marriages AND your current marriage certificate. You have to list all of the times you’ve been married before and you need to provide proof that all previous marriages have been dissolved in order to prove that the current marriage is legal.

It's quite possible they want both.  If it's an actual request from NVC, please provide the exact wording.  Sometimes women need to submit a prior marriage certificate as well as the applicable divorce decree.  It's about tracking name changes.  

 

If Miss Smith marries Mr. Jones, then divorces him, and her divorce decree only mentions Mr and Mrs Jones, without referencing her maiden name Smith, there is no way to know that Mrs. Jones was ever the Miss Smith whose birth certificate is being submitted.  If the divorce decree DOES mention her maiden name, there would be no reason to submit a prior marriage certificate, but it could still be asked for.

 

Note that if this name tracking issue exists, the prior marriage certificate should have already been submitted to USCIS.

No.  Submit to NVC a birth certificate for the child who is immigrating. Do it for the child's case, not the mother's case.

It's not for a woman, it's for my husband (beneficiary). He had been married before twice.

This is the exact wording from the CEAC Civil documents list for my husband:

and yes, they request OUR marriage certificate, as well. It is on the list, too, but separately.
