W2s but no tax transcript

Timeline

Trying to prepare for the NVC stage now that we've gotten our NOA2, but not sure what I should put here on the I864. I didn't file taxes for 2018 (sent it, but didn't make it fast enough in the mail so I didn't get my return and when I tried to check on the IRS site to see if I had any transcripts, it said there were none), but I have my W2s and my 1040 with my 2018 income on them. My income was below filing threshold. Under I864 Part 6 Item 24a should I include the total income of 2018 anyways (even though I didn't file) along with the W2s and 1040, check "not required to file" on item 25, and along with those include a letter of why I didn't file the last 3 years?

Have your husband take the transcript to the interview.  A complete copy of the tax return will satisfy NVC.

The IRS doesn't send "any return back to you".  The 1040 is your tax return.  Perhaps the IRS will send you a tax refund.

Yes that’s what I meant; I was due a refund but never received it as my mail file didn’t reach IRS in time, so I don’t have any transcripts online with them. So just the 1040 and W2s are okay?

Go with my first answer.  Your tax "refund" is irrelevant.  You'll get it when you get it.  What you send in to IRS is a tax return.  If you're due a refund, that's a tax refund, not a tax return, no matter how many people call the refund a return.

The thing is is that I don’t have a “transcript”, only the 1040. I requested a transcript and they said there were no transcripts on file for me. I don’t think they ever processed my 1040 in the first place so I’m wondering if I should amend for 2018 since it didn’t reach IRS in time and never got processed

IRS will process your tax return no matter when you send it.  It is possible they didn't get it.  Ask them.

 

"The 1040" is the main form of a tax return.  For some returns it is the only form besides the W2, 1099's etc.  For others, there are several other schedules in addition to the 1040.  A photocopy of everything you would have mailed to IRS, if filing by mail, is a complete copy of a tax return.  That will do for NVC.

 

If you are concerned the IRS doesn't have your return, contact them ask that specific question.  If they didn't get it, there's no need to "amend" it.  Just send it in again.  Did you file by mail or electronically?

Thank you, I will try to call them then. Yes I filed by mail since my husband doesn’t have an ITIN and we didn’t have time to get one, so I wasn’t able to e-file. I sent them a 1040 and my W2s by mail but I sent it off late and so it didn’t get there by April 15, I went to request my transcript online but they had nothing on record. So the NVC will take the 1040 and the W2s? I’ll try to get a transcript regardless, but since I sent my return by mail, I’m not so sure I have the federal copies of the W2s anymore, only the personal and state copies (didn’t file for state taxes because I wasn’t required, I only filed federally this year because I wanted to have my transcript for 2018 for NVC but that didn’t happen)

What you have will be fine.  IRS won't process your return until after the W7 is dealt with.  You've provided more details but my thoughts to you now, is the same as it was in my first response.

We never filed a W7, I filed married filing separately instead of joint and wrote “NRA” for my husbands SSN, we didn’t see the point in applying for an ITIN. Thank you for the response, I’ll use what I have for NVC, but I’ll try to get ahold of a transcript in case the consulate needs it for the interview to be on the safe side

Not sure about NVC as I went for the K-1, but the embassy in Stockholm were perfectly fine with my now husband's tax return that he got from our tax guy when he filed his taxes. It was the 1040 and whatever else that goes with it, it was probably 50-60 pages or so. We never had a transcript.

Oh wow, I hope they’ll still accept the same, I don’t have 50 pages though 😅. Maybe more around 4 if you count both pages of my 1040 and my 2 W2s, they were just temporary jobs to save up money when I was going to school part time so there wasn’t much to say for those. I’ll try to attempt to get the transcript just in case but that makes me feel better in case I can’t get ahold of one in time, thanks!
