Good day, 

 

im filling out the I-864 and I’m stuck on part 4, filling out information about myself.  I am currently living abroad with my husband in South Africa but I still have a U.S. address. It’s my mother’s house, but I still get mail there and it’s the address on my drivers license and my bank account, etc.  Do I use her address as my mailing address or my current address?  I’m sure I’m supposed to put my South African address as my physical address, but what about mailing?  

 

Also, can I put my country of domicile as the U.S.? I only hold a temporary residency visa in South Africa, so isn’t the U.S. still considered my country if domicile?

Hi Disfan01 - It's perfectly fine to put down your mother's address as your mailing address as long as the physical address is the current one. 

 

Yes, U.S. can be considered country of domicile. But you will have to prove domicile if living outside of the U.S. Go through the I-864's instructions on how to prove domicile, it will give you a better idea.

He will need to show evidence of INTENT to re-establish US Domicile at most.  Many misuse the word "prove" and the phrase "prove domicile" in this forum.  A petitioner is not required to be currently domiciled in the US, to act as primary sponsor for their immediate relative.

Facts are cheap...knowing how to use them is precious...

I have my Maryland Drivers Licence, voter card, some bank statements with my mothers address in the states and a copy of my temporary residency permit for South Africa that will be expiring at the end of November. I also will be writing a letter explaining my lack of income and why I have no recent tax records but that my intent is to start working again as soon as we arrive in the States (my temporary residency permit does not allow me to work in SA and we currently live only on my husband’s salary). Will that be enough to establish my intent to re-establish domicile?

I'm sure it will be.  Sounds like you actually HAVE domicile in the US, but your intent is clear, from all of that.
