Pros and Cons of filing I-129F (K-3) on I-130 Approval

Hi board,

 

After studying up the posts, it seems like most recent posts mention that filing an I-129f could potentially expedite the approval of an I-130. However, there are also earlier posts that says the exact opposite and how the I-129f might slow down the I-130 by a significant time, especially there's a time lag between the filing dates of the two petitions.

 

Does that mean it's a better idea to file the I-129f at the same time as the I-130 to the Chicago lockbox together? This way we avoid the gap between I-129f and the I-130 petition dates. Do we know the impact of filing an I-129f at centers other than NSC? I see people mentioning tracking spreadsheets floating around, where can I find these? Thank you all!

It's only worked at nsc and who has had issues of things slowing down? You mean people that say that it increases the workload for the service centers. Well too bad it's a legal avenue that's available. The form wouldn't be filed if there was a reasonable adjudication timeline. 

 

If you haven't filed yet. You won't know if you get nebraska. You can file both it does not hurt. 

 

Anyways answer this question for yourself.

That's all anyone has to go by if you're content with filing and forgetting go for it. If you want to try all options go for it. It's not rocket science. Though remember the more you delay in trying means the train might have left the station and you're out of luck the mistake at Nebraska is closed. Everyone's back in line. 

 

Also no one knows if it works on IOE issued receipts. Which anyone applying now will get but they still get assigned a service center. (train could have left for all these folks)

Thank you for the input. I read somewhere that in some cases the I130 was pulled out of line because of the I129 but never put back (so basically that the I129 PD essentially became their new PD, which is often at least a month later). If this is not the case then sounds like the I129 is definitely worth trying.

I also filed both, and I am also hearing negative things about filing both. It didn't cost me anything to file it. Also, when I checked, the processing time was faster for the I-129F.

Timeline

If you were to file a I129f, it would have to be after filing your I130, not at the same time. You have to have an already pending I130 to submit an I129f, as you need a copy of your I130 receipt notice. Doesn't matter how long or short it takes you to file after receiving I130 NOA1 though. We sent I129f in 5 and a half months after I130 NOA1. We just got our I130 approved and our I129f denied 2 days ago, 50 days after filing the I129f. It's also uncertain whether or not I129f will have any impact on I130 processing time outside of Nebraska Service Center, so I would hold off filing it until you receive what service center you are at. Potomac would be useless to send an I129f to because the processing time for I130 there is already so quick

  • July 31 2019: I129f NOA1
  • Sep 19 2019: I129f NOA2 (Denied - 50 days from NOA1)
  • Sep 19 2019: I130 NOA2 (Approved - 217 days from NOA1)

 

NVC Stage:

  • Sep 27 2019: Sent to Department of State
  • Oct 31 2019: Case number received (34 days since sent)
  • Nov 1 2019: IV & AOS fees received & paid
  • Nov 14 2019: IV & AOS submitted
  • Dec 18 2019: All docs accepted, but one additional doc requested (5 weeks from submission)
  • Dec 18 2019: Requested doc submitted
  • Feb 19 2020: Documentarily Qualified (9 weeks from 2nd submission, 14 weeks from first submission)

October 11 2020: Arrived in US!
