Did she go to the welfare office?(Department of Human Service, Department of Social Services, or anything similar....she would have traveled to the office to apply) That equals Medicaid benefits.

I am not 100% clear on this but from what I can tell this program is either Medical Assistance or Medicaid (things you do not qualify for) OR the health exchange program for your current state (referred to as MNSURE or MinnesotaCare) . If it is the health exchange, this makes sense why it would be asking your immigration status. Only legal immigrants would qualify for this program. Since you have not filed for AOS yet, you do not have the legal proof they will likely require. For instance, for the federal exchange, an immigrant may utilize their AOS NOA1 as valid proof, or an EAD, or the Green Card - whichever is first. From the documentation I have seen, it is likely MN requires the EAD first - something you don't currently have, and it will take some time to get.

 

So what you need to do is determine exactly what coverage this program is. If it is Medicaid stay far away.

File your AOS. If you get your AOS in by October, the new rules will not apply to you. You're going to have a long wait to prove your status though.

Other options: purchase a private insurance plan. They won't be asking you about your legal status in that case. That is pretty much the fastest way to have coverage.

 

For what it's worth the new rules do not prohibit someone from utilizing the state or federal exchange. It does say greater positive weight will be given to those who have private plans. The wording does not clarify what that means... but if you get your AOS application in before October, it won't much matter for you anyway.

we went to their office to pick up forms and yes it is similar to Department of Human Service, Department of Social Services. So that equals Medicaid? she says it is state insurance tho, thanks so much for your input!

Thank you so much for your reply! we getting AOS sent this week, forms filled, just gathering the additional docs,. The health guys did give us 30 days to reply, hopefully we have the noa1 and we can use that as valid proof. Thank you sooo much!

Okay....that sounds more like Medicaid and not the marketplace. 

You will probably not be eligible to be on her insurance if it’s Medicaid (but.... I would NOT apply...or even TRY to apply under her current insurance policy if it is Medicaid)

Correct. You have no current way of proving your immigrant status to them so they can't add you. State exchange and federal exchange programs work a little differently than private insurance companies that don't much care about proving your status, so long as you answer basic questions and pay the premium. Since they need to know if you are lawfully present in the US or not, you have nothing to provide them to prove it.

MNSURE, from what I can tell all falls under the same thing. It operates both Medicaid and the state exchange. But MNSURE seems to be the exchange. Check this page. https://www.mnsure.org/new-customers/whatis-mnsure/index.jsp Hopefully there is clarification here.
