Urgent: Taxes - no 1040 Received, but submitted a 1040

Timeline

As background, I am currently in the process of a CR-1 visa for my husband. 

 

I received a letter today stating that the IRS is missing my 1040 form. However, I filed my 1040 (paper copy, since I have to do married filing separately) for the 2018 fiscal year on April 13th, 2019 and the payment (which I owed) was deducted from my checking account on April 15th, 2019 (by the deadline). I have proof of this payment (which I made online through the IRS login portal) and deduction from my account. I am currently waiting for my NVC case number, but I know that I will have to submit tax transcripts during the NVC stage. Of course, I am immediately planning to file my 1040 again (although I don't really understand why they never got it in the first place), but how is this going to affect our immigration process? 

 

Any advice/help would be greatly appreciated. Thank you.

Are you certain the letter is genuine?  I would do some research and maybe talk to an accountant.  Is your 2018 tax transcript available online?

Hi, 

 

I got the letter on the IRS website when I went to check about making my next quarterly estimated payment (different salary situation this year that requires estimated payments). Anyway I called the IRS and they confirmed they indeed do not have my 1040... 2018 tax transcript is not available online on my account either.

Timeline

Along the vein of tax return transcripts, m tax return file (1040) was lost so I had to refile it and as such I still don’t have a tax return transcript for 2018 (and won’t have one until they’re done processing it). How does this affect immigration for my husband? We’re waiting for our NVC case number currently.

Since it is support for the i864, transcripts are required if I am not mistaken.   Hopefully they will process quickly as it is a mon busy part of there year

I hope so too. And yes I am also under the impression transcripts are required. I have transcripts for previous years, but so far no transcript for 2018 given my situation. Does this mean I have to wait to submit AOS until I get this transcript? Or is there a way to include why I don’t have it and provide it later down the line? Thanks

You can do it in pieces but it won't save you any time as it can't be completed until all evidence is submitted
