Expired Venezuelan Passport Recognizition and Question

I sent the email message below to the U.S. State Department in response to their memo regarding accepting expired Venezuelan Passports. 

 

Feel free to chime in.  Hopefully this will help others who are in the same situation as Claudia and I.  She intends on traveling to the U.S. (prayerfully) in August or September.  I'll respond with their response.

My name is @TandClaudia  My date of birth is 1/1/1111.

 

I have filed form I-129F (petition for a fiancée visa), my petition was approved, and it is currently in transit to the National Visa Center (NVC).  My petition number is WAC1234567890.

 

My fiancée's passport has been expired since August 2017.  She has applied for a prorroga (extension stamp) and this extension has not been processed by SAIME (Venezuelan Government).

 

Based on the policy memo from 6/7/2019, the State department would recognize her passport as eligible for travel and visa purposes.

 

I have two questions:

 

1.  When applying for her visa via form D-160, and purchasing plane tickets, should we use to original expiration date (2017) or the date 5 years beyond the original expiration date?

 

2.  She is currently a resident in Panama City, Panama.  Who should we contact should we have an issue of that extended expiration date being recognized by the U.S. embassy in Panama, the airline we select, Tocumen International Airport, or the airport that we select as our point of entry to the United States?

Thank you @Amadia! The only thing with Venezuelan's passport is which country is accepting the extension made it by Guaido. That's what we need to consider.  The only country until now I believe are U.S.A, Canada, Spain, Colombia & Ecuador.

Here's an update:

 

I have received three different interpretations of the memo.

 

I called the NVC and they said that in their meeting, they were told that if they encounter someone with a Venezuelan passport that has been expired for less than 5 years, they consider it valid.

 

The State Department referred me to the embassy.  I emailed the embassy, and they responded that if my fiancée had not yet received her prorroga, then she could not begin the process.  They also responded with a question that made me believe that they didn't understand my email.  I chose not to respond, because there was no value in me doing so.

 

I called my Congressman, and their office told me to print the state department memo and send it with her D-160.

Is your fiance outside Venezuela? If the answer is yes, she has an automatic extension, is valid for a visa. If she is inside Venezuela, then no, because you can't leave the country (by plane) with an expired passport.

Okay, if her passport expired like 4 1/2 years ago, she has not extension...lower than that she is okay. Remember the extension is for 5 year since expiration.

@PilsenCanela it expired in 2017

 

She requested the prorroga and it was never delivered. They told her to request it again and we are waiting for the status to change on SAIME’s website. 

 

I have faith that it will come soon andthis entire situation will be resolved. 

 

Until then, I’ll be more patient.

The good thing is that u can star the Ds160, the "porroga" is needed in case that she wanted to travel back to Venezuela or another country, once in the United States, she needs to wait for the "travel permit" at least. So I would say you guys have plenty of time.

Update:  I spoke at length with a Customs and Border Patrol supervisor at the airport in Orlando when I arrived from Panama the other night.  He indicated that my interpretation of the policy was correct.

 

Unfortunately, when I was at Tocumen International Airport in Panama City Panama three hours earlier and inquired, they insisted that she would need the prorroga in order to travel.

Based on Article 6 of the decree by Guaido, the Venezuelan Embassy in Panama should be able to provide her with something that shows the extension.  Hopefully they will be able to do it fairly quickly.

 

Articulo 6.  Si el estado recoptor require alguna prueba de la prorroga del pasaporta, las embajadas de venezuela en el extranjero podran prestar servicios consulares a los fines de estampar en el pasaporte la estampilla u otro documento similar en el cual conste la extension de la vigencia.  Los acuedos de cooperacion internacional comtemplaran mecanismos de reconocimiento de dichaestampilla o documento similar.
