Expect some added scrutiny that the marriage was entered into with bonafide intent since you just got your GC a couple of months ago and are filing for divorce soon after.  Good luck to you.

Yeah, I’m pretty much (removed)...

Only thing I got with a ton of proof to show we were bonefide is messages of us planning to move in to an apartment together and me transferring money for our car in to our joint bank account, along with recent photos...

Shared health insurance, joint lease, shared car insurance, joint or married filing separate tax filing, shared utility bills...anything like that?

Curious if you entered the US on a K1 or another visa?  If a K1, you also have under your belt a bunch of evidence previously submitted (that can be accessed by the IO, and may or may not be considered) showing true intent of marrying for reasons other than a green card, in your favour...at least there's that.

IOs tend to look at a person's entire immigration file before adjudicating something, if suspicion arises.

Well he lost his temper yesterday I had to get out. My stuff is still there and there would be no way to do counselling now.

I'm sorry, you can ask for a police escort to get your stuff and any  proof that you can grab at the same time. Just don't grab his stuff.

It's very telling that she's more worried about her immigration status than her marriage.

Whether fair or not, these cases should be automatically denied.  2 months after getting the conditional greencard- marriage "not working", and already had another guy lined up ready for marriage.  Should be denied and deported immediately.

I don’t have him lined up ready for marriage. Things had not been right with my husband since not long before I started my job. To the point where it was fighting everyday and his temper taken out on me. It was also violent last Friday I had to leave. Thanks for your support.

Yes I did do the K-1 then Adjustment Status and have all the paperwork. I did love him and wasn’t here just to get a green card, I know there are people out there that do but he was my sole reason for coming here. Since then I have established a living with a good job, things went sour 2 months in to getting my green card. He has a hot temper on him so much that I am scared to talk with him alone.

Yes. This happened with us liking each other the time me and my husband separated but we are not getting married any time soon as I want to do things the proper way and divorce my current husband. Obviously I was in love with my husband to leave my family behind to be with him and was happy around the time when I got my green card as we talked about plans for the future. However you are entitled to your own opinion and others are too on here. I can tell everyone until I am blue in the face that I didn’t marry just for a green card, which I didn’t, but I guess that makes no difference. Sorry I can’t be pure like everybody else who is perfect.

That’s your opinion.  On limited facts.  You’re free to express it, but the OP is looking for actual advice, not judgment.

Processing times for a green card aren’t as quick as they used to be, so it’s not like she’s only been married for 2 months.  Also, 2 people can enter a marriage with the best of intentions and have it fall apart  quickly, especially when it’s a marriage involving immigration.  My husband and I have struggled every day since I moved here with minor things (changes in living together), so for some people those struggles may be larger and of more significance.

Until you’ve walked the mile in her proverbial shoes....

  • 4 weeks later...

Hello,

I know a few people would have seen my previous threads. I was just wondering if anyone would be able to give me any experiences in regards to filing for ROC after divorcing your US spouse. I had some really good advice on what to expect in my previous threads and I appreciate them all. Just wondered if anyone has personally been through it and can give me an example of filing and what you sent off to USCIS in regards to evidence that the marriage was in good faith, which mine definitely was.
