I-130 Question about CR1(merged)

Timeline

Here is my situation. My wife is Canadian and still residing in Hamilton, Ontario. I'm the petitioner trying to bring her to America. I'm still here in New York. There is a question on the I-130 petiton saying

 

"The beneficiary will not apply for adjustment of status in the United States, but he or she will apply for an immigrant visa abroad at the U.S. Embassy or U.S. Consulate in:"

 

And then it ask, city, province and country. Should I put the closest U.S Embassy to where she lives, which is in Toronto, or does this not apply?

Montreal, Quebec, Canada: https://ca.usembassy.gov/visas/family-immigration/

At least she is relatively close. In contrast, applicants from Vancouver tend to fly to Montreal instead of drive, etc.

Yes, I was thinking this exact thing. She also has always wanted to visit Montreal, never got the chance in her life, so it is a win/win I suppose. Better brush up on some Francais....thank you

They also used to process visas at the Vancouver BC consulate. However, that ceased a few years ago.

At least the closest options for the medical are just an hour drive away: https://travel.state.gov/content/travel/en/us-visas/Supplements/Supplements_by_Post/MTL-Montreal.html

Another quick question. For those who don't know I'm the beneficiary for my Canadian wife. I understand that different countries have different processing times for whatever reason. Any idea how long it may be assuming everything for my CR1 is approved on the first time go? Also what are some good ideas to prove our relationship is bona fide? I'm currently active duty military so I have added her to my insurance with documents showing she is currently covered under Tricare and Insurance claims for if I die during active duty. I have pictures of our wedding with her mother and father in the pics and also pics of when she visited my family for Christmas. So we have pictures together with both our families in them. I have flight itineraries, credit card statements from kays jewelers for her engagement ring. My wife still has letters from when I went to basic training back in 2010 that I want to make photocopies of and use. Can anyone think of anything else that might help out?

About 13-15 months for non-military.

Unlike Canada the US immigration doesn't have different processing times for countries, it's merely how backlogged a particular consulate or embassy is.  Montreal is pretty backlogged and it can take 2-8 months for an interview.  Normally 2 months after case complete at the NVC but recently has been as long as 8 months. 

 

Canada requires very little evidence and is a pretty easy consulate for Canadian born citizens. It can be a little more difficult for those who are born or have connections to high fraud countries obviously (like Pakistan for example.)

 

Your list of evidence sounds fine.

I think your listed evidence along with your marriage certificate is sufficient for this stage.......as a military spouse, she should be able to collect more good evidence for later immigration stages....Good Luck.

August 7, 2022: Wife filed N-400 Online under 5 year rule.

November 10, 2022: Received "Interview is scheduled" letter.

December 12, 2022:  Received email from Dallas office informing me (spouse) to be there for combo interview.

December 14, 2022: Combo Interview for I-751 and N-400 Conducted.

January 26, 2023: Wife's Oath Ceremony completed at the Plano Event Center, Plano, Texas!!!😁

February 6, 2023: Wife's Passport Application submitted in Dallas, Texas.

March 21, 2023:   Wife's Passport Delivered!!!!

May 15, 2023 (about):  Naturalization Certificate returned from Passport agency!!

 

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

Best of luck to you with your filing!  As mentioned, your evidence sounds good and Canada is one of the easier consulates to go through.  

Not sure how long you've been married, but tax filings showing her as your spouse is also beneficial as you move along with her immigration process.

We are coming up on our first anniversary which is July 12th. So coming up on a year. Yes I know I said I went to basic training in 2010 and we know each other. hahah. Our story dates back to America Online Days......but thank you for your good luck wishes.
