Proving residency in Mexico

I moved to Mexico in Dec 2018.  I had my son here in April 2019.  I will start the process for getting my permanent residency in Mexico soon, but I understand in Cancun there's a 4 month wait to get your card.  I'd like to start my husband's I-130 for his green card in June as that'll be 6 months since I moved here.  I have passport stamps for entry to Mexico and bank statements that show withdrawals from my checking & savings accounts here in Mexico, but that's all.  Our initial rental agreement was just in my husband's name, although the place we are currently living is in both names.  Utilities are generally in the landlords names here, so we don't have that proof.  I am not working either.  Any advice?

August 7, 2022: Wife filed N-400 Online under 5 year rule.

November 10, 2022: Received "Interview is scheduled" letter.

December 12, 2022:  Received email from Dallas office informing me (spouse) to be there for combo interview.

December 14, 2022: Combo Interview for I-751 and N-400 Conducted.

January 26, 2023: Wife's Oath Ceremony completed at the Plano Event Center, Plano, Texas!!!😁

February 6, 2023: Wife's Passport Application submitted in Dallas, Texas.

March 21, 2023:   Wife's Passport Delivered!!!!

May 15, 2023 (about):  Naturalization Certificate returned from Passport agency!!

 

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

confused!

you are looking into permanent residency in Mexico and /or looking for his residency here?

 

if applying to mexico,  check with Mexico web page

for the US ,  many things you need to do

1   keep a US residency/ do not have to live in it but have it available to return to the US

2   the USC must meet 125% poverty level income to support total family members

3.  must file tax returns while you are in Mexico 

4.  get the US passport for your son

I’ve got my son’s US passport and CRBA.  We will all live with my parents and they will provide financial support initially while I’m looking for employment again. I don’t have any reason to file a tax return since I don’t have any income. 

 

But my initial question at hand is about items that can be used to prove residency in Mexico since I don’t have my permanent residency status yet? I want to do DCF from Mexico.

You realize that DCF as resident of Mexico is going away?

If you are in an other office . . . who knows.

Thank you for the information. I’m assigned to the Mexico City office. However, I should probably look into filing the traditional way now. ☹️😭

INM says it will take 4 months?  Mary got her Meixcan green card in about 6 weeks.  But she had a permanent resident visa.

Yes. Several people have reported it taking months to get residency here in Mexico due to turnover in employees in the INM offices because of corruption. I will be applying for permanent resident visa as well. I have everything but my son’s Mexican passport and the appointment is a couple of weeks away.

I never went through the official residency process while living in Mexico, but I proved that my wife and I were living there together through bills and the lease, we translated any and every documentation that I had with my name and address on it for the process (we had to do a K-1 since marriage wasn't an option). The bank statements are a good solid record.  Can you get cable or internet in your name?

But according to your timeline you did a K1 vs a Spousal Visa filed at the consulate?

Yes, as mentioned we did a K-1 Visa since we could not marry in Mexico.

She is married and wants to file with USCIS in Monterrey.   She is going to need the documents they specify.

She has a passport stamp and lease but no legal status (RT or RP) in Mexico. No utility bills, no taxes, no driver's licence.  Usage of a US bank account is irrelevant. 

 

She didn't come into Mexico on the correct visa (RT or RP) or go with her husband right away to INM and get an RP.  Her tourist visa is about up and looks like she isn't going to be able to change visas there before the DCF program ends in Mexico.
