Rejection Notice - What is the issue ?

Hi –

 

I entered the US as a K1 visa, got married, and applied for adjustment of status, which means that I filled out the forms I-485 (Application to register permanent residence or adjust status), I-864(Affidavit of Support), and I-765(Application for Employment Authorization).

 

However, I received my documentation back by mail yesterday telling me that my application was rejected for the reasons indicated on the I-797 Reject Notice. There are 2 I-797 Rejection Notices – One is stapled above I-485 that says mainly:

 

This is in reference to the I-485, Application to Register Permanent Residence or Adjust Status, you submitted. Your I-485, fees, and any supporting documentation is being returned to you for the following reason (s):

 

You must sign your application in the signature block if you are 14 years of age or older. Your parent or guardian may sign their name in the signature block if you are younger than 14. Your signature or parent’s or guardian’s signature in the “Signature of person preparing form, if other than above” block is not a valid signature for this purpose. Please sign and send the application with the correct fees to the address listed on the bottom of this page.

 

Please be sure to complete the application fully, submit the appropriate fees, and include all required supporting documentation. […]

 

… and another is stapled above I-765 says mainly:

 

The entire application package you filed along with any fees you submitted is being returned to you for the following reason(s):

 

The principal application could not be accepted for the reason(s) specified on the related Notice of Action (Form I-797). Therefore, the processing of all riding applications cannot continue. […]

 

From what it says, I understand that the only issue is regarding the signature of the form I-485:

 

I am the applicant, I am older than 14, and nobody helped me fill out the application, so I signed all the forms except form I-864, which was signed by my sponsor, in black ink.

 

When I entered my receipt numbers online to have more details about the reasons of my rejection, the first receipt number tells me that my application was rejected because “you did not sign your form.” But as I go through page 15, part 10, 6.a, of form I-485, I can see that I properly signed the form. Same thing for I-765, which was properly signed on page 4, part 3, 7.a.

 

The second receipt number tells me that “we rejected your Form I-765, Application for Employment Authorization because it was not filed correctly.” What do they mean by not filed correctly? I cannot see any issue with the signature in all of the forms. Is there any other issue? The only issue they mention in the first I-797 Notice is the signature, and the second I-797 (The one stapled above I-765) says “the principal application could not be accepted for the reason(s) specified on the related Notice of Action (Form I-797)”, which means that they refer to the one stapled above I-485, saying that the only issue is the signature, which seems to be fine.

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

I can venture the guess your I-765 was not accepted because it is only "free" when filed together with I-485, and since they rejected your I-485, they had to reject I-765 as well. 

 

I do not have a good answer for you with regards to signature. I double checked, and Page 15 is the right place for the signature and the date for I-485. It is possible they made the mistake.

Thank you Shiran ! I thought too that it is possible that they made a mistake, but let's wait for others insight - I might be wrong.

The only thing I can think of, other than it must be in blue/ black ink, is if the signature on the application was waaaaaay outside the signature block.  They can be fussy about that, sometimes, as the signature gets electronically scanned.
