Timeline

Hi just in need of clarification to help a friend.  What form does one need for a joint Affidavit of support for a k1?  Is it form I- 134  to be fill by the sponsor  and  form I-864 to be fill by the only joint sponsor? Or both the sponsor and joint sponsor have to fill only form I -864?  Thanks.

Separate i134 by each

Form I-134 is the Affidavit of Support that's used for temporary or “non-immigrant” visitor visas. ...

Form I-864 is the Affidavit of Support that's used for permanent or immigrant visas. This form is for people who are coming to live in the United States permanently as green card holders

Yes, you need a separate I-134 for the petitioner (sponsor) and a separate I-134 for the joint-sponsor. Also, request the most recent tax return transcripts for both the sponsor and the joint sponsor by filing form 4506-T with the IRS.

Question:

We are filing for the green card using RapidVisa. They are telling me that because my income was insufficient for ONE of the three years they requested, that we would get an RFE or a denial and that I should get a co sponsor. But on the USCIS website, it says that you are required to ONLY submit LAST YEAR'S taxes. You have to include what your gross income was for the past 3 years on the form, but you are NOT REQUIRED to include the documentation for 2017 and 2016....only the last year. Last year my income met the requirements, 2017 it did not, 2016 it did. Cant I just submit my 2018 taxes, all my paystubs from 2019 and my employment contract to show that 2019 will be a stable year?

They want to see your past salary records, not your projected salary prediction. What are you going to do if they ask to see your documentation supporting your claimed income for prior years ? I would strongly suggest that you should not prevaricate, the COs are trained to spot fraud and lying.

Makes no Sense as to why you need a co-sponsor,

your current income and 2018 income is good enough to support you all, sure though send them 17 and 16, 3 years docs is required.  One down year is not going to be the end all or require a sponsor. During interview, explain why it was a down year (changed jobs etc). just don't lie about it.
