My ex husband and are soon to be divorced and have been separated for about a year and a half

Divorce should be final by may of this year.

But about a year ago I met a man online from Seirra leone. I went to see him in his country in December of last year and him and I would like to get married. I do plan on going back to his country in may but I am unsure if him and I will be able to legally get married there because they do not accept gay marriage. Again I am a transgender woman. My passport does have female on it. So I guess my question is what is the best way to file for him to come here to be with me?

You need to answer the marriage question first.   Marriage before Visa or marriage after the visa.   Once that has been decided,  you Visa option is decided for you

YMMV

It really depends.  I would recommend researching the various family options from the guides.  You can find the guides on the blue bar right under the VJ logo at the top of the page.  Since your plan is to get married in the future, your options are K1 or CR1, so I would focus on those guides.  K1 is for having a fiancé come to the US and then get married within 90 days, and CR1 would be to get married anywhere and then file as a spouse.

Good Luck!

There are only two paths; 1) K-1 fiance visa or 2) spousal visa.  Which path is better depends on you being a US citizen or green card holder and where you can legally marry.

Are you a US citizen or a green card holder?  If you are a green card holder, then you can only go the spousal visa route.

If you can not legally marry in his country, then both of you can travel to a country where you can get marry.  K-1 fiance visa for marrying in the US if you are a US citizen.  A green card holder can not file for a fiance to come to the US.  Other countries allowing gay marriage may have their own visa requirements.
