My auntie petitioned my father under F4 ( sister to brother). My mother, brother and I are the derivatives.

me and my brother are aged out but our name are still in CEAC and interview letter. and we paid IV and medical was also done.

Last 4th of April, we had our interview. My parents was approved but me together with my brother was not eligible for CSPA and reached the maximum aged.

My passport and my brothers' didn't return by the consul. What does it means? As I read here in forums, it should returned right after the interview.

In CEAC, only two was issued (my parents) and two was still ready (me and my brother). 

I need to retrieve it as soon as possible because I am working abroad and need my passport back.

Probably the best way would be to contact your embassy and ask them.

09.2015 - Green Card received.  

RoC

24.07.2017 - NoA1.

01.08.2018 - RoC approved.

we called the Embassy to update regarding my passport. but with the tune of their voice they are also wondering and keep on asking us why the passport was not returned. And answered them that maybe we are apply as family?

No such thing.  Families apply as individuals

so I was also clueless why they didn't return the passport. The letter they gave us was "we are unable to is issue you an immigrant visa because have been found ineligible under the following section of the immigration and nationality act as amended.

212(a)(5)(A) you reached the maximum age and are not eligible under the child status protection act (CSPA)"

its frustrating that I was denied then now I can't go back abroad for my work.

They should not hold your passport hostage.   They need to return it.

I calling them but telling that just wait for the passport and it will be sent via courier. my flight will be  this coming Tuesday and its week end now. Im helpless.

Why not ask for the passport right after the interview denial?

 

Did you believe at the time them keeping your passport might have gotten you a visa?

we don't know the process of the whole interview..  We thought that they will send the passport all together.

Then when I read some threads here, It should be return back right after, so what I did was Call the embassy for clarification. But I didn't get the definite answer.

all they were saying was it will be sent via courier.

These are just my thoughts

  • They might take the passports accidentally 
  • They will send the passports back but it can take sometimes: thing is urgent to you does not mean urgent to them.
  • Did your parents receive their visas? If not, just wait your brother's and your passport may be include.
