Change of Employer while H1B being filed

I suppose you don't quite understand the "under the table" games that go on? 

 

Companies (esp many shady Indian consultancies) almost always recoup sponsoring costs from employees one way or another. More often than not, its mostly about having a company/consultancy to file PERM/labor etc; and as soon as a i140 is approved, employees jump ship. In the end, it's all about getting a start on the coveted green card, even if the wait is years.

That's not what was stated. Nobody stated you can't change employers.

They stated that an existing application cannot be transferred or amended. A new one is needed.

Correct, that is what was stated. It is still accurate.

There is no amendment to be submitted. Amendments are when there is a material change in the terms or conditions of employment by the petitioner.

There is a new petition to be filed by a new employer. This is under the classification of a change of employer, but it's still a new petition that is adjudicated based on the merits of the case. It's not a transfer.

You’re right. (Sigh)

Hopefully when they push for more skilled visas they’ll do more to address these issues as well. They seem to have started doing it with Ls already but those might be easier to check on.
