Income requirement - AOS or ROC?

Hi, I'll be going to AOS after some months and was wondering if AOS still need income requirement to be met or would that be for ROC?

 

If it is for ROC, and both of us work, I could go to part time without causing issue of not meeting the requirement or do I still need to meet the requirement regardless of what my partner make? I currently do meet the requirement at the moment, but wanting to cut back on heavy hours 60+ so I can focus on losing weight.

 

Would appreciate it. & Sorry mods, I wasn't sure where to put this thread.

hi,

 

in the AOS, in the ROC the taxes are needed to prove comingling of finances, not what the amount of income is

 

but for AOS the petitioner needs to be above the poverty guidelines for the beneficiary to get the GC, your income is irrelevant

 

plus how are you working at all if you don't have your work permit? you stated that you will be going through AOS, so how is it that you are legally working in the US?

I'm the USC Petitioner, just now realized what I said wrong. Whoops. It's my Fiancé who is going through the AOS and such but I'm also helping him with that.

the affidavit is needed at the AOS stage

 

the ROC is to prove again bona fide marriage and the same affidavit stands

you will need evidence of comingling of finances at the ROC

Right, so the Petitioner still have to maintain the financial requirement through ROC alone?

no affidavit needed, they only want proof of bona fide marriage 

 

you are still his sponsor, but no new affidavit needed,. only proof of bona fide marriage and comingling of finances

Oh ok. So I'm submitting the Affidavit of support for the US Embassy, will I have to make a new one for AOS?

Yes. I-134 for embassy. I-864 for AOS.
