Well tomorrow we will be mailing out letter to withdraw our application. I say we just got dealt a bad hand with the IO who gave us a second review. Better luck next time! It says it's up to someone at the field office whether or not they will honor the request for withdrawal. If they don't honor the request they proceed forward.

There isn’t any reason for you to pull it if all they requested of you is to was more documentation. If you pull that now, it would not change when next you apply because they would then ask more questions with regards why you canceled you previous application and even more scrutiny. It won’t affect his residency even if he is denied.

I read from a different thread for filing on the 5 year rule the burden is on USCIS to prove that the relationship is not legitimate whereas the 3 year rule it'd on the applicant to prove its legitimate. There's no signs of fraud in our case they will have a hard time finding something.

 

Also the RFE said if we pull it, it won't effect any applications submitted in the future and will hold no prejudice.

It doesn’t matter if you file 3 7-8 years as long as you got you GC through marriage they will always ask questions. Like I said if you have nothing to hide then there should be no reason to be worried but then again It is your choice

If you don't go out, or have much of a paper trail, do you have each other's as beneficiaries on savings/retirement/pension or life insurance accounts? Will, living will? Emergency contact? State ID or driver's licence at the same address? Did you allow your husband to get his driver's licence?

No Will. No life insurance. Submitted emergency contact with initial application. We did send a copy of my driver's license and his state ID. We both agreed that it's best for him to wait to drive till he's a citizen in case he gets a ticket.

How about health insurance, a copy of your patient record that list each other as the next of kin or emergency contact (send it again), any pets that you take to a vet and your names on vet records or adoption records of that pet? 

How about birthday, Christmas, anniversary cards with both your names on the envelope, any type of junk mail that comes in gather it all as it will show both your names at the same address. 

Car repair bills? 

Bank statements that show both of you using the same account. 

 

At my interview even though everyone said they don't ask for more proof at the interview. That they would have everything from the list when applying. I was still asked and I knew they would because that is just my luck. I didn't bring much more with me but I did use a few receipts from the drugstore that showed his insurance for my inhalers. That was enough just one extra thing. I didn't matter that he was in the waiting room with our daughter she still wanted one more thing. 

 

Search your place high and low and find everything you can with names and addresses on.
