My husband and I filed the i-601 waiver and are currently waiting for the IR1 visa. He went back to El Salvador little over 2 weeks ago. He admitted to the doctor that he used marijuana and they made him go to a psychologist to be evaluated. My question is do they tell you after the interview if you will need to receive treatment? Or do they hold off on the interview until after you've completed treatment? He has not done treatment but they asked him to schedule the interview. I just want to mentally prepare myself and our 4 year old daughter.

Your thread title says "Failed Drug Test".  Did they test him, or did he just admit it when questioned?

August 7, 2022: Wife filed N-400 Online under 5 year rule.

November 10, 2022: Received "Interview is scheduled" letter.

December 12, 2022:  Received email from Dallas office informing me (spouse) to be there for combo interview.

December 14, 2022: Combo Interview for I-751 and N-400 Conducted.

January 26, 2023: Wife's Oath Ceremony completed at the Plano Event Center, Plano, Texas!!!😁

February 6, 2023: Wife's Passport Application submitted in Dallas, Texas.

March 21, 2023:   Wife's Passport Delivered!!!!

May 15, 2023 (about):  Naturalization Certificate returned from Passport agency!!

 

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

If the only issue is the admitted use, it will be a decision by the psychologist. They could determine that there is no health issue and that will be it. They could also determine there is a potential health issue and there will be up to a 1 year ban, in which case he may or may not have to undergo testing to ensure he stays clean.

I-601? That can only be filed after the interview when they determine he is inadmissible for the visa.

 

Or did you mean I-601A for unlawful presence?

If so, there is a risk of this becoming invalid. If he is found to be inadmissible on health grounds, the I-601A becomes invalid and an I-601 will be necessary once he is determined otherwise eligible for the visa.

Unfortunately, the scheduling process is embassy/consulate specific. i don't know El Salvador's process there and don't want to misspeak, sorry.

They tested him both times he went to the doctor and failed both times. He thinks they tested because he admitted to use.
