When to apply for SSN? (K1 holder, got married, K1 just expired, haven't applied for AOS yet)

Hi everyone,

 

Just looking for some advice on whether I'm doing things correctly.

 

I entered the US in late October, we got married Dec. 14th '18, my K1/i-94 just expired on Jan. 28th.

 

I want to apply for a Social Security Number, and then file for Adjustment of Status once that process is completed...Does this make sense to do things this way? Will there be an issue with applying for the SSN while my i-94 is expired?

Really needed to do it within first few weeks of arrival. My husband already has a SSN from a J-1 internship prior to us meeting so I'm not entirely familiar with the process, but since your I-94 expired you'll have to wait now since you have no legal status.

08/15/2014 : Met Online

06/30/2016 : I-129F Packet Sent

11/08/2016 : Interview - APPROVED!

11/23/2016 : POE - Dallas, Texas

From sending of I-129F petiton to POE - 146 days.

 

02/03/2017 - Married 

02/24/2017 - AOS packet sent

06/01/2017 - EAD/AP Combo Card Received in mail

12/06/2017 - I-485 Approved

12/14/2017 - Green Card Received in mail - No Interview

Agreed with above.  A K1 SSN should be applied for about a week after arrival, and before the marriage.

 

Since you’re out of status, you have to wait until you have a document to show you’re eligible.

Will there be an issue with applying for the SSN while my i-94 is expired? Yes. You can only apply for an SSN in the name that matches what DHS has on file for you up until your I94 expires. 

You will have to wait for your EAD or GC to be approved, whichever comes first.

You can get one via an EAD or green card at this point.

Need to? It is suggested to do so as it has the least likelihood of having any issues with SSA employees. It is not required to do so...people have successfully applied both after marriage and have used a marriage certificate to obtain an SS card under a married name (my wife did this last year).

Thank you for stating that "least likelihood" part. I'm just tired of reiterating what rules the SSA is supposed to follow (but often does not for some lucky ones) when this topic has been posted and is searchable. Their I94 is expired anyways so it really doesnt matter. Thanks again!
