Can i file EAD, AP and SSN without filing AoS as long as i marry my fiance within 90days

I've been hearing conflicting stories but I want to get the accurate answer here.

 

Can I file Employment Authorization Document, Advanced Parole and Social security number for my fiance after marrying her within the 90days but withhold filing Adjustments of Status to a future date due to the high cost

 

Is there a downside to doing it this way?

 

NoA1 - September 26, 2018

NoA2 - February 4, 2019

You can acquire the SSN.

 

You can't apply for EAD or AP without the I-485 for AOS.   Filing for the I-485 is what allows you to apply for the EAD and AP...

 

So no. Just file for AOS after the marriage as required and known about. "Cost" isn't a good reason for not doing so since it is known about before hand the process and cost. Hence the whole sponsorship.

02/24/2017 - AOS packet sent

06/01/2017 - EAD/AP Combo Card Received in mail

12/06/2017 - I-485 Approved

12/14/2017 - Green Card Received in mail - No Interview

Yes.  Filing ead and AP before filing aos will require a fee payment (no longer fee waived) and will be based on the k1 90 authorized stay.  AP will be denied,  EAD will come expired

SSN - yes

AP - no

EAD - yes, but it's only good for the 90 days after entering on the K-1, so it's worthless and will cost you money.  Free when filing for AOS.

 

If money is tight, then beg or borrow to pay for AOS and file for the free EAD.  That's the quickest way for her to start making money.

Only SSN.

 

The EAD and AP are like a "sub-application" under the larger AoS application. Without the AoS, you have no basis for the EAD and AP. The EAD and AP are also only free if filed along with AoS
