Child has a path to immigration if not k2 ftj then i130 (assuming less than 18 yrs old).

Agree. I don't think anyone here said otherwise. 

But I also don't want to minimize the omission as not relevant.

November 6th, 2018 State ID Card Received, Applied for Global Entry - Feb 8,2019 Approved.

July 14, 2020 Removal of Conditions submitted by mail  July 12, 2021 Biometrics Completed

August 6, 2021 N-400 submitted by mail

September 7, 2021 I-751 Interview, Sept 8 Approved and Card Being Produced

October 21, 2021 N-400 Biometrics Completed  

November 30,2021  Interview, Approval and Oath

December 10, 2021 US Passport Issued

August 12, 2022 PHL Dual Nationality Re-established & Passport Approved 

April 6,2023 Legally Separated - Oh well

omission of this fact can be considered material misrepresentation.

 

you will have to file a cr130 for the child and go through the entire process for her. This will take a lot of cooperation on her fathers part regarding documents/ medical exam/ etc You will also have to address why she was not listed on the original petition and hope it does not cause issues.

 

How long it will take will depend on the age of the child. a little over a year for a minor (assuming there are no issues with the fact she was omitted on the K1) or several years for an adult child.

All of the above, plus a possible DNA test to prove parentage.

Thanks for all the advise, it's not that I never mentioned my child to my fiancee (by then), they even met before we started the k1 process but my daughters father didn't want her daughter to be in my custody because of family issues I can't mention here, so when my fiancee(then) asked if she could include her, I said No because I knew her Dad couldn't allow her travel with me, I thought once she is mentioned, she should be able to travel with me, we didnt research much about it.

Note that I mentioned to my fiancee that I have a daughter at the first day we started talking, I never hid her from him, he loves her and takes care of her when we get a chance.
