Benefit Received By Other Means indication (split topic)

I submitted both an i-129f and an I-130 back in July. I got the notice today that the i-129f was "Case Closed Benefit Received By Other Means."  The website also shows this.  When I called in to USCIS they told me both my cases still showed that the cases were active. A rather rude gentleman in tier 2 told me that, I should stop talking and listen the website and the text notification must be wrong" because he still showed both cases under review. 

Do the automated systems update before the customer service people's systems? Or was the tier 2 CSR correct?   Hopefully the i-129f is actually cancelled and the i-130 approved.

The people that first answer the phone have the same information that is displayed on the website/text notifications. Tier 2 can see a bit deeper but dont have access to everything the actual Officer working on the case does.

 

The online system is a COURTESY and USCIS makes no claims to its accuracy. Tier 2 reps have also been known to provide incorrect info on occasion.

 

Most likely the Officer working on your case entered a code to close out the 129f- hence the automated system saying such. The case may still be showing as 'in review' if the Officer still has it open in their system. You should not look at the 129f being closed as an indication of anything more then someone closing the 129f. It does not mean the 130 was necessarily approved- just that they stopped the 129f. At least they are working on something of yours! Hopefully it wont be much longer. You can get a jump on whats needed next using the guides.

The truth is they always close the I-129F for spouse.  They've been doing it at USCIS for a year or more.  NVC was the place they got closed (with rare exception) since February 1, 2010.  Forget the K3.  It's been an obsolete unavailable visa for several years.

Damara, you were right. Today the system at the USCIS Cust Serv showed the i129f cancelled. All cool. I still have no notice of the I-130.....      Im on pins and needles. I have all the paperwork ready for the NVC ... fingers crossed

January 28, 2014: Production of new Green Card ordered

February 3, 2014: New Green Card received; done with USCIS until fall of 2023*

December 18, 2023:  Filed I-90 to renew Green Card

December 21, 2023:  Production of new Green Card ordered - will be seeing USCIS again every 10 years for renewal

I-130 APPROVED!!! 2 days after getting the notice the i-129f was cancelled. 2 days after a RUDE Tier 2 customer service rep got curt with me and told me that the systems showed my i129f and i130 both still in place and under consideration and that the website was wrong and I should STOP ASKING!!!    What a tool....  

It was funny I got the text first for the i-129f that it was "We closed your Form I-129F, Petition for Alien Fiancé(e), because the applicant or petitioner received a status or benefit through other means." then it took a day for the USCIS people to see that the i-129f was cancelled but they still insisted that the i-130 was not approved (it was their systems must take 24 hr to update). But the New case status website showed the i-130 approved first. The old one still is not updated.

August 7, 2022: Wife filed N-400 Online under 5 year rule.

November 10, 2022: Received "Interview is scheduled" letter.

December 12, 2022:  Received email from Dallas office informing me (spouse) to be there for combo interview.

December 14, 2022: Combo Interview for I-751 and N-400 Conducted.

January 26, 2023: Wife's Oath Ceremony completed at the Plano Event Center, Plano, Texas!!!😁

February 6, 2023: Wife's Passport Application submitted in Dallas, Texas.

March 21, 2023:   Wife's Passport Delivered!!!!

May 15, 2023 (about):  Naturalization Certificate returned from Passport agency!!

 

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..
