While they are waiting for their CR-1/2 visas to be approved my husband and his son want to visit me in USA on ESTA and stay here up to 90 days at a time. The child needs to be enrolled in school (he is 14 y.o.) I did a research through immigration websites. Technically, the answer is "no" - because ESTA is equal to a tourist visa and precludes work/study activity. But the child is eligible to a permanent resident status and his immigration petition is pending. Can it be seen as an exception to the rule? Did somebody have a similar experience?

No, the ESTA rules are very clear. You have NOT been approved for the CR-1 visa yet. Don't try to risk losing ESTA forever and violating immigration laws just for a short visit. Wait your turn.

There are no exceptions to the rules.  Attending public school would be an immigration violation.  

There is no technicality about anything.  The law is clear.  

The VWP is for visiting and attending school is prohibited.  Visitors visit.  They don't attend school like they are living here.

Being eligible to be a permanent resident and having a pending immigration petition confers no rights to do anything.  It is to wait in line for an immigration visa that allows a person to come and live here.

Nope, no exception. Their status prohibits that activity. Any future status or permitted activities is irrelevant.
