Hello everyone,

 

I currently have a pending asylum application and have an EAD (employment authorization card) that I got thru the asylum application I filed. Now, I’m getting married next month.

 

My questions are:

-Do I need to re-apply for a new EAD since the one that I got now ia for my asylum application?

-Will it be hard to go through the green card interview because of the pending asylum application? The relationship is real and me and my fiance decided to get married and live together since we’ve been long distance for more than 2 years now.

Hello Notantifun,

 

I moved here last year because of a threat on my life. I’m gay and the Philippines is still not that accepting in terms of homosexuality, specifically my family. This is the reason why I applied for an asylum when I came here.

 

After a few months, USCIS granted me an EAD.

 

However, my boyfriend proposed to me and we plan to get married. I know that you also get an EAD for K-1 visa. So I’m wondering if I need to apply for another EAD given that I already have an EAD for the pending asylum case.

Typically the existing asylum claim must be resolved before doing AOS.

Seek a qualified immigration attorney to confirm on the next steps.
