No payment for I-765 if you sumbit it with I-485

Hey, 

 

So i am confused about the filing fees for the adustment of status (i485) and the work authorization (i765.) I have read in a few comments that you only need to pay the i485 fee if you are submitting a i765 at the same time. I than looked at the government immigration page and says nothing about this....

 

 

Can anyone help?

This, just include the form in the packet.

21 Aug 2013: I-129F Sent

11 Feb 2014: Visa APPROVED!

20 May 2014: Wedding!

No need to pay for I-765 and I-131 if you send it with or while having a pending I-485.

 

you can send them together.

if you check the instructions of the i485, the fees of the i765 and i131 are waived or included when sent all together in the adjustment of status packet

Filing Forms I-765 and I-131 with Form I-485

If you are filing Form I-485 (or already filed a Form I-485 on or after July 30, 2007), you do not have to pay an additional fee to also file a Form I-765, Application for Employment Authorization and/or Form I-131, Application for Travel Document for advance parole. You may file these forms together. If you choose not to file Form I-765 and/or Form I-131 with your Form I-485, then you must submit a copy of your I-797C, Notice of Action, receipt as evidence of that you filed a Form I-485.

If you filed your Form I-485 before July 30, 2007, you must pay the fees associated with Forms I-765 and/or I-131 when you file them.

I-129F* (I-129 is a petition for an employment-based visa)

 

Yes, you can apply for an SSN within the first 76 days of entry on the K-1 visa (90 days - 14 days of legal status required), or once you get an EAD or green card.

You cannot work with just an SSN...until you get a green card, the card will only be valid for work with DHS authorization....which is the EAD.

Only "trick" is to file a complete and accurate I-485 application + I-765, as to avoid an RFE.

If you have a firm job offer, you can request an expedite on the I-765. This can still take months to obtain and is not guaranteed, but is a commonly used expedite path.

Are you using a joint sponsor for the I-864?
