Hi all, need your advise. I think these questions have been asked but I cant get the right one as all answers are difference. We dont get NVC case number yet, we just want to prepare it first.  

1- My USC wife has IRS tax transcript, 1040 and W-2 in 2015, 2016 and 2017. in 2017 she filed tax as "Marriage Jointly" and I got ITIN number.

     - In Part-5, Item-4 asked "My current individual annual income". so which income amount part, section, line in IRS tax return, 1040 or W-2 to put ?

     - FYI in Part-5, Item-6a, 6b and 6c, we will put "Total Income" from income section in IRS tax transcript form. I think line 22 in 1040. 

2- There is her aunt's family(divorced with 3 kids, she has own job to support won family) is living in her house but my USC wife does not support any financial, sponsor or claim on tax to them. 

     - In Part-4 please advise if these below is wrong. 

       - Item-1.a. "Yourself and the person you are sponsoring on this form I-864EZ" is 2. My wife and I.

       - Item-1.b. "Your Spouse" is 0. Already put me in Item-1.a.

       - Item-1.c. "Your dependent children under 21 of age" is 0. My wife has no any children. 

       - Item-1.d. "If you have sponsored many other person on a Form I-864 who are now lawful permanent residents in The United State, enter the number here" is 0. My wife has never sponsored anyone before.

       - Item-1.e. "If you have any other dependents listed on your most recent Federal income tax return, enter the number here" is 0. Already put me in Item-1.a.

       - Item-1.f. "Add together Item-1a. to Item-1.e. HOUSEHOLD SIZE" is 2.

None from W2 or 1040 or taxreturn in Item 4. Current annual income is total annual income she will earn in 2018. Income from 2017 or ealier years are past incomes not current.

2015-06-16: I-130 Sent

2015-08-17: I-130 approved

2015-09-23: NVC received file

2015-10-05: NVC assigned Case number, Invoice ID & Beneficiary ID

2016-06-30: DS-261 completed, AOS Fee Paid, WL received

2016-07-05: Received IV invoice, IV Fee Paid

2016-07-06: DS-260 Submitted

2016-07-07: AOS and IV Package mailed

2016-07-08: NVC Scan

2016-08-08: Case Complete

2017-06-30: Interview, approved

2017-07-04: Visa in hand

2017-08-01: Entry to US

2016-05-16: N-400 NOA1

2016-05-26: Biometrics

1) Current income is the income she should make per year.  To calculate take her hourly earning wage x hours per week x 52 = current yearly income.  This is different than what is on a w2 etc...

2) 2 is the correct household size for your wife.

Thanks @NikLR , her hours per week is 40hr but sometime she's asked to OT. should she include it ?

Correct, and just to confirm, "employed" people do not get their "current income" from a tax return.  NikLR has correctly explained how it is calculated.  It is NOT what one will make in 2018.  It's what they'll make in the 12 months following the date they complete and sign the affidavit.

Facts are cheap...knowing how to use them is precious...

No.  Assuming the affidavit is being completed now, it is going to be the next 12 months from today.  "Current Income" cannot possibly be "last year's income".  If you take a job today, for X pay per year, then that X pay per year is your current income, regardless of what you earned in any previous period.  If you lose your job today, your current income tomorrow is ZERO, no matter how much you made before.

Facts are cheap...knowing how to use them is precious...
